국문 초록

데이터는 지능정보사회에서 혁신성장을 견인하는 핵심자원이 되었다. 사람과 사물이 다각적으로 이어지는 초연결 사회가 도래함에 따라 데이터 주도 경제(Data-driven economy)로 전환이 가속화되고 있다. 데이터에 대한 공정한 접근과 다양한 활용을 보장함으로써 사회 전 분야에 걸쳐 혁신을 유도할 필요가 있다. 이러한 점에서 데이터 3법의 개정은 늦은 감이 있으나 적절한 개정으로 평가할 수 있다. 데이터 3법의 개정으로 테이터의 개방과 거래가 허용에 따라 새로운 금융상품과 서비스를 개발하여 금융혁신을 선도해야 하고, 금융소비자에게 유용한 상품이나 서비스를 제공하는 과제를 안게 되었다. 데이터의 이용은 기존의 금융회사뿐만 아니라 여러 스타트 업이나 핀테크 업체에 열려 있는 것이므로 상호 역할 분담 및 제휴를 통한 발전 방안을 마련하여야 할 것이다. 한편 정보화 사회의 등장으로 개인정보의 침해 문제도 증가하고 있는 바, 개인정보의 보호 및 사용의 적절한 조화가 필요하다. 금융회사는 준법감시제도를 강화함으로써 정보유출 등에 대한 피해가 발생하지 않도록 최선을 다해야 할 것이다. 헌법의 하위법으로써 법률에 의하여 제도화되고 있는 데이터의 수집 및 이용 보호 등은 헌법적 한계 내에서 설계되고, 그 기능이 발휘되어야 한다. 또한 데이터가 거래되고 현실에서 데이터의 이용 및 활용에 대한 법리적 문제점에 추가적인 연구가 필요하다.

영문 초록

Data has become a key resource driving innovation growth in the intelligence information society. With the advent of a hyper-connected society in which people and things continue in various ways, the transition to a data-driven economy is accelerating. It is necessary to induce innovation across all sectors of society by ensuring fair access to data and various uses. In this respect, the amendments to the Data 3 Act may be belated but can be evaluated as appropriate amendments. The revision of the Data 3 Act puts the task of leading financial innovation by developing new financial instruments and services in accordance with the opening of the testers and allowing transactions, and providing useful products or services to financial consumers. The use of the data is open to not only existing financial firms but also to various start-ups or FinTech companies, so development measures through mutual role sharing and partnership should be devised. On the other hand, as the issue of infringement of personal information is also increasing due to the emergence of an information society, proper harmony in the protection and use of personal information is needed. By strengthening the law-abiding monitoring system, financial firms will have to do their best to prevent damage to information leakage and others. The protection of the collection and utilization of data, etc., which is institutionalized by law as a sub-law of the Constitution, shall be designed within the constitutional limits and its functions shall be exercised. Further research is also needed on the legal issues of data trading and data utilization and utilization in real life.
