국문 초록

본고는 2013년 1월부터 2014년 6월까지 해외에서 출간된 해양법 관련 논문들을 통해 해외의 연구동향을 파악하는 것을 목적으로 한다. 구체적으로 분석의 대상 범위를 다음과 같이 제한하였다. 첫째, 대상 논문은 전문 저널에 발표된 것만 대상으로 하였으며, 단행본의 일부로 구성된 논문은 제외하였다. 둘째, 해양법 전문 저널과 일부 중요 저널은 전수조사를 하였으며, 나머지는 Westlaw에서 몇 가지 주제어를 넣어 검색하였다. 이를 통해 총 43개의 논문을 분석 대상으로 삼았다. 분석 대상이 된 최근 논문들은 해양법협약 제76조의 대륙붕 개념, 200해리 이원 대륙붕 외측 경계 설정에 있어서 CLCS와 국제법원의 관계, 해양분쟁과 분쟁해결을 주제로 한 논문들이 많았다. 남중국해에 관한 연구는 대부분 중국과의 해양분쟁을 다룬 것이고, 특히 중국이 주장하는 9단선과 역사적 권원의 국제법 부합 문제를 많이 다룬다. 북극해와 관련해서는 북서항로에 대한 논문이 많은 점이 의외이다. 연구자들의 연구업적 편수를 통해 눈에 띄게 드러나는 점은 중국(대만 포함) 학자들의 국제저널 저술 활동이 압도적으로 많다는 점이다. 이는 중국 정부의 해양력 강화정책과 궤를 같이 하는 것으로 추정된다.

영문 초록

This study is to find recent research trends on the law of the seas by examining articles published from January 2013 to June 2014. For the examination, 43 articles from international journals, including American Journal of International Law, Ocean Development and International Law, International Journal of Marine and Coastal Law, Chinese Journal of International Law, have been analyzed and evaluated respectively. For the analysis of the research trends, the author classified them into 8 categories based on the UNCLOS in principle: 1) territorial sea and contiguous zone, 2) EEZ, 3) continental shelf, 4) high seas, 5) maritime dispute settlements, 6) maritime delimitation, 7) South China Sea disputes, and 8) the Arctic Ocean. As a result of the classification, it is found that the categories of maritime dispute settlements, South China Sea disputes, maritime delimitations and Arctic Ocean have been the most popular topics for scholars during the period. It is also meaningful to find that Chinese scholars are the most active in publishing articles on the law of the sea in international journals.
