국문 초록

이해충돌은 부패는 아니지만 공직자가 직무를 수행하면서 공익 또는 공적의무와 사적 이익간에 충돌된 경우 공익을 우선하여 함에도 불구하고 공직자 자신 또는 타인에게 사적이익의 기회를 제공하거나 공직자등이 사적이익을 얻게 하는 상황에 놓이게 함으로써 직무의 공정성과 청렴성, 민주성 등을 저해하는 것을 말한다. 공직자에 대한 이해충돌을 방지하지 않으면 직무의 공정성이 훼손되고, 국민에 대한 불신감이 높아지며, 직무의 투명성과 민주성을 저해하게 된다. 현행법에서는 헌법, 공직자윤리법, 공무원행동강령, 청탁금지법에서 이해충돌금지의무를 규정하고 있으나, 이해충돌의 개념이 명확이 정립되지 않고 있고, 주식매각 및 백지신탁에 대한 규제, 주식취득제한, 사적이해관계신고 등을 통한 이해충돌규제의 한계가 있다. 또한 이해충돌관련 현행법은 이해충돌에 대한 세부적인 유형과 이해충돌을 판단하는 세부적인 기준, 이해충돌 위반시 솜방망이식의 징계나 행정형벌이 지나치게 낮아 그 실효성이 의문이 되고 있다. 공직자는 국민전체에 대한 봉사자로서 공익을 사적이익보다 우선하여 직무를 수행하여 직무의 공정성과, 투명성, 신뢰성, 민주성을 확보하며, 공직자의 부패를 사전에 방지하여 청렴한 공직사회를 구현하기 위하여 부패방지법의 제정이 시급히 요청되고 있다. 이 글에서는 이해충돌의 개념을 명확하게 정립하고, 현행 이해충돌방지법 체계와 미비점을 검토하여 이해충돌방지법 제정의 필요성을 제안한다. 또한 2020.6.25. 정부가 발의한 이해충돌방지법안의 주요내용을 소개하면서 법적 쟁점으로 대두될 수 있는 사안을 미국, 캐나다, 프랑스, 크로아니아의 입법례를 참고로 이해충돌 대상 직무의 명확화, 사적이해관계자 합리화, 공공기관과 공직자 범위의 적정성, 이해충돌방지법 위반에 대한 불이익조치의 적법성, 주식･부동산매각･백지신탁으로 구분하여 고찰하여 그 개선방안을 제시한다.

영문 초록

Conflict of interest is not corruption, but in the event of a conflict between public interest or public duty and private interest while performing duties, it provides an opportunity for private interest to the public official himself or others, or allows public officials, etc. to gain private interest, despite giving priority to the public interest. It refers to impairing the fairness, integrity, and democracy of the job by putting it in a situation. Failure to prevent conflicts of interest for public officials undermines job fairness, increases distrust of the people, and hinders transparency and democracy of duties. In the current law, the obligation to prohibit conflicts of interest is stipulated in the Constitution, the Public Officials Ethics Act, the Code of Conduct for Public Officials, and the Anti-Solicitation Act, but the concept of conflict of interest is not clearly established, and restrictions on the sale of stocks and blank trusts, restrictions on the acquisition of stocks, and private interests. There is a limit to the regulation of conflicts of interest through relationship reporting, etc. The detailed types of conflicts of interest, detailed criteria for judging conflicts of interest, and the effectiveness of the cotton bat transplantation in the event of a conflict of interest are too low to be disciplined or administrative penalties. Public officials, as volunteers for the entire public, perform duties prior to public interests over private interests to ensure fairness, transparency, reliability, and democracy in their duties, and to prevent corruption of public officials in advance to realize an integrity public service society. Also on June 25, 2020 Introducing the main contents of the Conflict of Interest Prevention Act initiated by the government, and clarifying duties subject to conflicts of interest, rationalization of private stakeholders, scope of public institutions and public officials on matters that can emerge as legal issues by referring to legislation in foreign countries such as the United States and Canada. The adequacy of the law, the legality of penalties for violations of the Conflict of Interest Prevention Act, stocks, real estate sales, and blank trusts are considered, and measures for improvement are presented.
