암수범죄 해결 및 수사력 보충을 위한 공인 민간조사관 도입방안

국문 초록

여러 가지 수사 측면에서 현실적인 문제점에 직면한 우리나라는 민간조사제도를 도입하고자 시도하였으나, 국민의 수요와 요구가 증가함에도 불구하고 근거 법령조차 법제화하지 못하고 있다. 이 연구에서는 위와 같은 관점에서 이미 제도화되고 면허화된 성공사례로써 미국의 민간조사면허제도의 특징을 분석해보고자 하였으며, 앞으로 우리나라에도 도입될 민간조사제도에 유용한 도움을 제공하고자 하였다. 미국에서 민간조사관이 되려면 일정 기간 수사나 조사 관련 경력을 쌓고 면허국에서 실시하는 면허시험에 합격해야 한다. 민간조사관이 제공할 수 있는 서비스의 영역은 보모의 신원확인에서부터 무역 정보의 보충에 이르기까지 광범위한 전 범위에 해당한다. 즉, 민간조사관의 주요 업무는 고객이 신원조회, 재산 및 소재파악 등에 대한 정보를 대리로 조사해주는 업무를 수행하고 있다. 물론 연방제의 성격상 각각의 주마다 자격요건 및 면허취득과정 또한 차이를 보이지만 교육과정 이수시간 이외에 큰 틀에서의 자격요건은 크게 다르지 않음을 보인다. 다만 국내의 경우 민간조사제도를 국가공인자격 또는 국가공인면허로 제정하기 위해서는 저촉되는 변호사법, 헌법, 법무사법 등과 같은 여러 법안과 권한의 개정 및 재정비가 필요할 것으로 보인다. 현재 국내에 존재하는 자격증으로는 한국특수직능교육재단에서 발급하는 민간조사사 자격증(PIA)이 유일하며, 응시자격요건 규정이 실무 경력에 초점을 둔 반면 도덕적 자격에 대한 규정은 제시되어 있질 않다. 따라서 미국 공인민간조사관 면허와 같이 응시자격에 있어 도덕적·실무적 자격을 구체적으로 규정하여 이전부터 국내에서의 민간조사에 대한 부정적인 인식을 소멸시키는 것이 바람직하다.

영문 초록

Faced with a number of practical problems in terms of investigation, Korea has attempted to introduce a private investigation system, but it has failed to legislate even the basis laws despite the growing demand and demand from the people. In this study, we wanted to analyze the characteristics of the U.S. private survey license system as a successful case already institutionalized and licensed from the above point of view, and to provide useful help to the private survey system that will be introduced to our country in the future. In order to become a private investigator in the U.S., ones must have a certain period of experience related to investigation or investigation and pass the license test conducted by the licensing agency. Areas of service that can be provided by private investigators range from identification of nanny to supplement trade information. In other words, the main task of a private investigator is to conduct a proxy investigation of information on identity inquiry, property and location identification. Of course, the nature of the federal system also shows that the qualification requirements and licensing processes vary from state to state, but the qualification requirements in a large framework other than curriculum completion time do not differ much. In Korea, however, it seems necessary to revise and reorganize various bills and authority, such as the Attorneys-at-Law Act, Constitution, and Law and Law, which violate the private investigation system, or to establish it as a national official license.
