캐나다의 여성 범죄자 교정처우 동향과 정책적 함의

국문 초록

이 연구에서는 캐나다의 교정제도와 여성 범죄자에 대한 처우의 주요 내용과 동향을 분석하여 향후 우리나라 교정당국에서 여성 범죄의 억제와 바람직한 교화개선, 효과적 재사회화를 위해 적극적으로 검토해야 할 정책적 대안을 모색하였다. 연구결과, 캐나다는 여성 범죄자들을 위해 주간 가석방(Day Parole), 전면적 가석방(Full Parole) 등 다양한 조건부 가석방 제도를 통해 사회내 처우를 확대하고 있는 가운데 적극적인 시민 참여를 기반으로 하는 지역사회 연계 교정 프로그램을 활발하게 실시하고 있는 것으로 나타났다. 그리고 각 교정시설에서는 여성 수형자들의 특성에 따라 단계별 교육 프로그램을 운영하고 있으며, 이들에 대한 심리지원과 정신건강 서비스, 현장 밀착형 직업훈련과 취업지원을 위한 지역사회 고용 코디네이터 제도 등 다양한 활동을 전개하고 있는 것으로 파악되었다. 또한 체계적이고 전문적인 교정처우를 위해 연방 교정청 내에 여성 범죄자부와 여성 담당 부청장 제도를 설치, 운영하는 등 여성 범죄자를 위한 선진화된 교정 시스템을 운영하고 있는 것을 알 수 있었다. 그러므로 우리나라에서도 캐나다와 같이 다양한 조건부 가석방 제도를 도입하고 가석방 위원회의 개선을 통해 수형자의 가석방 비율을 확대하는 등 여성 범죄자에 대한 사회내 처우를 활성화해야 할 것으로 보인다. 그리고 지방자치단체 및 지역사회 내 관련 기관과 연계하여 여성 수형자를 위한 직업훈련과 취업알선 프로그램을 개발하고 시민 주도형 참여제도를 활성화하여 지역사회가 주도하는 적극적 지원체계가 운영되도록 해야 할 것이다. 또한 교정본부 내에 가칭 ‘여성지원과’를 설치하고 법무연수원의 교정직 교육과정의 내용을 개선하여 여성 수용자들에 대한 처우의 전문성을 향상시켜야 할 것이다. 끝으로 여성 수형자들의 심리지원을 위해 여성 수형자 전담 심리치료센터를 확충하고 충주여자교도소에 ‘일자리 센터’를 개소하여 전담 취업지원 코디네이터를 배치하는 방안을 고려해야 할 것이다.

영문 초록

This study analyzed Canadian correctional system and major content, trend of its treatment for female offenders. In doing so, the study sought to find police-wise alternatives which our country s correctional authorities should positively consider for the control of female offenses and ideal correctional improvement and effective re-socialization. As a result, the study found that Canada was actively conducting correctional programs in linkage with local communities based on citizens positive participation, while the country was increasing treatment in the society using diverse conditional parole systems including day parole, full parole for female offenders. And it also found that the country s each correctional facility was operating phased educational programs in accordance with the characteristics of female prisoners and was performing diverse activities such as psychological assistance for them, mental health service, field-based vocational training and employment coordinator system in the community to help them employed. Besides, the study learned that Canada was operating advanced correctional system for female offenders by establishing and running the department for female offenders and the system of deputy commissioner in charge of them within the country s federal department of corrections for systematic and professional correctional treatment. Therefore, the study believes our country should improve the treatment in the society for female offenders by introducing conditional parole system like Canada and advancement of parole committees and expanding the rate of parole for female prisoners. We should develop programs of vocational training and employment programs for female prisoners in linkage with local autonomous entities and related organizations within the communities. We should also activate citizens-led participation system in order to implement positive assistance system led by the communities. Along the way, the study suggested to establish the department for assistance of females (tentative name) within the correctional headquarters and improve content of curriculums for correctional jobs in legal research institute in order to advance the professionality of treatment for female prisoners. Finally, the study suggested to expand psychological treatment centers for female prisoners and open ‘job center at Cheongju Women s Correctional Institution and deploy exclusive employment-assisting coordinators.
