국문 초록

해상운송은 국제운송에서 여전히 가장 중요한 운송수단이며, 운송의 성질상 독자성이 강한 법체계를형성하여 왔다. 국제물품운송에 관한 규범 체계는 헤이그규칙, 헤이그-비스비규칙, 함부르크규칙, 로테르담규칙 등의 국제규범을 토대로 각국의 사정에 따라 하나의 규칙을 국내법에 수용하여 규정하는 방식을 취하고 있다. 이러한 방식의 수용은 각국의 해상운송에 관한 규범 체계가 다원화되는 현상으로이어져 국제적으로 여러 가지 불편한 문제를 발생시키고 있다. 따라서 본 연구는 해상운송계약에 관한 국제규범으로서 최근에 UNCITRAL에서 제정한 로테르담규칙과 중국해상법의 규정을 각각 살펴보고, 주요 조항에 대한 비교분석을 통해 그 차이점을 밝히고 있다. 이를 통해 향후 해상운송계약에 관한 국제통일규범인 로테르담규칙의 발효 가능성과 중국의 해상운송에 관한 국제규범의 수용 가능성과 그 영향에 대해 살펴보고 있다. 본 연구의 결과, 헤이그-비스비규칙이 제정되고 반세기가 지나고 있는데도 불구하고 운송환경의 변화에 따라 제정된 함부르크규칙 및 로테르담규칙의 발효는 요원한 상태에 있어서 국제통일규범이 절실한 해상운송분야에서 대국으로 성장한 중국의 해상법을 살펴보았다. 중국해상법은 여전히 헤이그-비스비규칙을 근거로 하고 있는 가운데, 시대적 상황을 반영하여 화주에게 불리한 부분을 일부 개정하고있다. 따라서 최근에 제정한 로테르담규칙의 수용을 통한 국제통일규범의 발효는 아직 상당한 시간이필요할 것으로 보인다.

영문 초록

In international transport, maritime transport is the most important means of transport. In particular, the nature of its transport has created a strong legal system. The normative system of international commodity transport is based on the Hague rules, the Hague-Visby rules, the Hamburg rules and the Rotterdam rules, etc. As such, the diversification of the normative system of maritime transport in each country has caused many inconvenient issues internationally. Therefore, this study examines the Rotterdam Rules enacted by UNCITRAL as international rules of maritime carriage of goods by sea and Chinese Maritime Law, and reveals the difference by comparing and analyzing major clauses such as the scope of application, liability of the carrier, limits and period of liability and electronic transport records. The purpose of this paper is to examine the possibility of Rotterdam Rule, the international standard of unification of maritime transport contracts in the future, and the possibility and acceptability of international rules on maritime transport in China.
