국문 초록

시청각 공동제작협정(audio-visual co-production agreement)이란 당사국의 인이 공동으로 제작한 시청각물에 대해 국내 제작물 대우를 해주고 국내제작물이 받을 수 있는 다양한 특혜가 명시된다. 2019년 현재 한국은 유럽자유무역지역(EFTA), 싱가포르, 캄보디아, 유럽연합(EU), 호주, 인도, 뉴질랜 드, 베트남, 프랑스 등 9개 국가와 공동제작협정을 체결하고 있다. 이 논문에서는 한국이 기 체결하였 거나 앞으로 체결할 공동제작협정과 관련하여 세 가지 법적 문제를 분석하고자 한다. 첫째, 공동제작 협정 일부 규정의 법적 구속성 여부, 둘째, 제3국 당사자의 자격을 양 당사국 중 한쪽이 공동제작협정 을 체결하고 있거나 양해각서(MOU)를 체결하고 있는 국가로 제한하지 않고 모든 국가가 자유롭게 참 여할 수 있도록 하게 된다면 한국의 국제법적 의무와 양립 가능한지의 문제, 셋째 공동제작협정 하의 재정적 기여비율 등 요건이 현행 법령에서 요구하는 내용과 다른 경우 법적 문제가 되는지 여부에 대 해 분석한다.

영문 초록

The “audio-visual co-production agreement” stipulates that the audio-visual products co-produced by the persons of the parties shall be regarded as domestic audiovisuals and to awarded various special treatments that domestic audiovisuals are entitled to. As of 2019, South Korea has signed such co-production agreements with nine countries or parties, including the European Free Trade Area, Singapore, Cambodia, the European Union and Australia, India, New Zealand, Vietnam and France. In this paper, I will review three legal issues regarding the co-production agreement that Korea has signed or is expected to negotiate. The first issue is whether some provisions of the co-production agreement are legally binding. The second issue is whether it is compatible with Korea’s existing international legal obligations when the qualifications of the third parties to the co-production are not limited, for instance to those parties that the contracting parties have a co-production agreement or a memorandum of understanding. The third issue is whether it would be legally compatible when the conditions on the domestic status of co-production such the financial contribution under a co-production agreement are alleviated than those required by the existing legal provisions of Korea.
