싱가포르의 부모부양 제도에 관한 연구

국문 초록

싱가포르와 우리나라는 모두 유교문화의 영향을 받아 왔으며, 독립 후 단기간에 눈부신 경제발전을 이루어왔다는 점에서 유사하다. 또한 모두 저출산･고령화 문제에 직면하여 사회문제로 대두되고 있다는 점에서는 동일하다 할 수 있다. 이에 본 논문에서는 싱가포르의 부모 부양정책의 현황과 1995년 11월(1996년 6월 시행)에 제정된 ‘자녀에 의한 부모의 부양 및 그 관련사항에 관한 규정을 정립하기 위한 법률’(An Act to make provision for the maintenance of parents by their children and for matters connected therewith)의 주요내용을 살펴봄으로써 우리나라에서 얻을 수 있는 시사점을검토하고 있다. 싱가포르는 복지국가가 되는 것을 부정하고 철저히 본인의 능력에 따른자기책임의 원칙을 강조하고 있다. 노인복지정책도 이러한 사회보장의 기본방침 하에가족의 가치를 강조하며 사적부양에 의존하고 있는 실정이다. 이에 반해, 저출산 대책에 대해서는 국가 경제발전이라는 명목 하에 고학력 여성 등을 대상으로 복지를 제공하고 있다. 그럼에도 불구하고 아직까지 저출산 대책에 대한 큰 성과가 나오고 있지 않고, 오히려 고령화는 더욱 심각한 수준으로 도달하고 있는 실정이다. 한편, 싱가포르는부모부양법을 시행함으로써 부모가 경제적으로 곤궁상태에 빠졌을 때 자녀의 부모에대한 부양의무 이행을 요구할 수 있게 되었다. 하지만 자신의 생활에 지장이 없을 정도로 경제적으로 여유가 있는 경우에 한하여 부양의무가 부담되고, 재정적 지원을 필요로하는 부모에 대해서만 부양요구가 인정된다. 그렇기 때문에 이를 이용할 수 있는 자는매우 한정적일 수밖에 없다. 부모부양법은 확실히 노인의 소득을 담보하기 위한 안전망으로서의 역할은 하지만, 이대로 고령화가 계속 진행된다면 부양기간의 장기화로 인하여 경제적으로 여유가 있는 자라 할지라도 그 부담은 커질 수밖에 없을 것이다. 특히, 저출산으로 인해 1인당 부모를 부양하는 자가 적어지면, 1인당 부양자의 부담은 더욱늘어나게 될 것이다. 이렇듯, 고령화 사회에서 과도한 사적부양에의 의존은 많은 문제점들을 야기하게 되는바, 사적부양 우선의 원칙은 반드시 재고되어야 할 것이다.

영문 초록

Both Singapore and Korea have something in common in the aspect of being influenced by Confucian culture and also having achieved great economic development in a short period of time after the independence. They also have the same social problems caused by low-birthrate and aging society. Thus this paper aims to review implications for Korea, by examining the current status of senior welfare policies and the Act to Make Provision for the Maintenance of Parents by Their Children and for Matters Connected Therewith established in November 1995(Enforced in June 1996) in Singapore. Singapore denies to become a welfare state, and also emphasizes the principle of self-responsibility in accordance with individuals abilities. Its senior welfare policies are depending on the private support by emphasizing the value of family under the basic policy of such social security. On the other hand, regarding the low-birth measures, the welfare is provided to the well-educated women under the cause of the national economic development. Nevertheless, there have not been noticeable outcomes of the low-birth measures yet while its aging gets more serious. Meanwhile, by enforcing the Parents Support Act, Singapore can ask children to perform the duty of supporting their parents. However, the support duty is given only when children are well off enough to support them. Also, the demand for support is recognized only for the parents necessary to have financial support. That is why the users of this system can be very limited. Even though the Parents Support Act plays a role as a safety net to guarantee seniors income, if the aging phenomenon continues like this, the financial burden even to people with economic affluence will be grown due to the extended period of support. Especially, if the number of people supporting parents per person is decreased by low-birthrate, each supporter s financial burden will get more increased. Since such excessive dependence on private support can cause lots of problems in aging society, the private support system should be reconsidered.
