국문 초록

전통지식의 보존은 저작권과 특허 등과 같은 지식재산권의 전략과 밀접하게 관련되어 있다. 전통지식은 저작권과 밀접하게 관련되거나 또는 현행 저작권의 별도 요소로서새로운 법 체제 하에서 보호될 수 있다. 그럼으로써 전통지식으로부터 이익을 얻는 자라면 누구든지 사회에 어느 일정의 이익을 돌려주어야 한다는 것이다. 전통지식은 생물다양성의 보존 및 이용과 밀접하게 연결되어 있다. 1992년 생물다양성협약(CBD)과 2010년 나고야 의정서의 채택 이후 전통지식의 보호에 대한 개발도상국들의 관심이 크게 높아지고 있었다. 최근에는 전통지식이 바이오산업이나 의약산업, 한의학, 농업, 생명과학 분야에서 신제품 개발의 중요한 원천이 되고, 전통지식의 기술적인 가치와 경제적 잠재성에 대한 인식이 높아지면서, 개발도상국의 전통지식을 선진국이 남용하거나 부정 이용하는 것으로부터 보호하기 위한 정책의 필요성이 크게 제기되어 왔다. 최근까지 개발도상국을 중심으로 자국 내 전통지식의 경제적 유용성 및 전통문화의 유지, 발전과 관련되어 국제적 협약 수준으로 보호하기 위한 적극적인 노력이진행되고 있다. 그러나 개발도상국의 원주민이나 지역공동체가 보유한 전통지식 보호와 관련되어 선진국 등과의 국제적으로 논쟁이 가열되고 있지만 서로의 입장이 너무달라 조정과 합의 도출은 쉽지 않다. 특히 기존의 지식재산 체계에 의한 전통지식의 보호는 국제적으로 양극화된 논쟁의대상이 되고 있다. 지식재산권으로 전통지식을 보호하기 위해 기존의 지식재산 체계에전통지식을 포함시키는 방안과 독자적인 법체계를 제정하려는 방안, 또는 이 두 방안을조합하려는 방안 등이 논의되고 있다. 일부 국가에서는 전통지식 보호를 법률과 헌법으로 다루고 있다. 그러나 아직까지 명확한 유형의 입법은 나타나지 않고 있다. 또한 수많은 연구와 제안이 있었고 다른 국제포럼의 주제로 채택되기도 하였다. 이러한 여러 가지 노력에도 불구하고, 전통지식 보호의 목적과 방법, 가능성에 대해 여전히 의문이 남아 있다고 할 수 있다.

영문 초록

Protection of traditional knowledge is closely related to strategies of intellectual property law such as copyright and patents. The knowledge can be protected under new laws closely related to copyright or as a separate and distinct element of the copyright system as it now exists. The objective is that whoever obtains profits from the knowledge should give back a percentage of the profits to the community. Traditional knowledge is closely linked to the preservation and utilization of biodiversity. The adoption of the Convention on Biological Diversity (CBD) in 1992 and the Nagoya Protocol of 2010 were significant steps toward the protection of traditional knowledge in developing countries. In recent years, traditional knowledge has proved to be an important source of new product development in the biotechnology industry, pharmaceuticals, oriental medicine, agriculture, and life sciences. As awareness of the technological value and economic potential of such knowledge has risen, developing countries increasingly are asking for its protection from abuse or illegal use by developed countries. Until recently, developing countries sought protection through international agreements to enable economic use but still maintain ownership within the indigenous and local cultures that originated the knowledge. At present, however, there is hot debate among developing and developed countries over use of such knowledge, but totally different opinions make it difficult to reach settlement or consensus. Part of the international discussion is on whether protection should be governed by entirely new laws in each country, or should come under the existing intellectual property system, or some combination of the two approaches. Although some countries have used laws or constitutional rulings, clear and specific type of legislation still has not appeared. There have been a number of studies and proposals, and several international forums have addressed the subject. Despite these efforts, however, there remain many questions on the purpose, the method, and even the possibility of traditional knowledge protection.
