영문 초록

The 21th century is said to be a knowledge-based society in which creation of knowledge and information and its use play a very important role. In particular, contents which are based upon individual creativity such as film, music, game, animation, character, cartoon etw. are characterized by one-source multi-use, so that when original contents is successful, then it is able to develop various genre, which produces huge added value. Therefore, many countries and global companies are seeking to develop creative contents with good quality. However, in the digital era the contents are so easily and cheaply reproduced that anyone in the internet can reproduce them without any consent of contents owner, which brings about problems regarding copyright. In this regard there has been an incompatible conflict between right owners and users in the digital era, in particular, relating to not only private reproduction including an issue on ‘fair use’ but also moral right of author. In the recent time a proposal to introduce a regulation on ‘fair use’ into Korea Copyright Act has been submitted to the National Assembly, and it is under discussion, The article handles with both private reproduction and moral right of author in the digital era, which seem to be important issues in the field of copyright in Korea.
