TV 오락 프로그램의 표절 요소 분석에 대한 탐색적 연구

국문 초록

TV 포맷은 법적 보호의 경계에 위치한 콘텐츠로, 표절 시비가 끊이지 않고 있는 대상이기도 하다. 본 연구는 국내 인기 예능포맷 3편과 이의 표절작으로 의심되는 중국 포맷 3편을 분석, 포맷의 주요한 구성요소와 선택 및 배열 방식, 전체적인 분위기를 비교 분석함으로써, 표절의 지점을 밝히고자 하였다. 원작과 표절 의심 프로그램에 대한 외적 분석과 내적 분석, 선택과 배열 방식에 대한 분석 결과, 주로 표절되는 부분은 유형, 주제, 소재, 배경 등 외적인 부분에 집중되는 것으로 나타났다. 반면, 개별 캐릭터의 성격으로 인해 전반적인 느낌에는 다소 차이가 나타남을 확인할 수 있었다. 이러한 경향은 리얼리티 포맷의 경우, 더욱 두드러지게 나타났다. 스튜디오 콘테스트 형식을 띤 <히든싱어>의 경우, 진짜 가수를 가려낸다는 주제는 다소 보편적이지만, 독특한 요소의 선택과 배열을 통해 프로그램의 재미를 유발하며, <은장적 가수>는 이러한 독창성까지도 모두 유사한 것으로 나타났다. 국내 포맷에 대한 무분별한 표절을 줄이기 위해서는 유형이나, 주제, 소재, 배경 등 아이디어 수준의 특징에서 더 나아가, 선택과 배열 면에서 독특한 포맷성을 확보할 필요가 있을 것으로 판단된다.

영문 초록

The status of TV formats is said to be marginal from the legal protection and TV formats themselves have been the target of plagiarism ever since. Therefore, it is even more difficult to decide if a certain program plagiarizes another one because it has been always the controversial issue since the crystal clear legal method for plagiarism is hard to find. This study attempted to set the analysis framework for plagiarism using plagiarism factors based on precedents and interviews with creators. These factors are divided three categories: external test factors are format sub-genre, theme, subject, background ; its selection and combination; and intrinsic test factors(overall impression). With this framework, we tried to examine three Korean format programs and their similar Chinese programs which allegedly plagiarized Korean counterparts. As a result, main plagiarism occurred on the external part such as sub-genre, theme, subject and background. However, in due to differences from individual characters, overall impression varied. This result was emphasized even more in reality entertainment genre. In the result of comparison test between Korean and Chinese , Chinese counterpart looked identical not only in theme, subject and background but also in unique combination and format factor selections. In order to avoid plagiarism, Korean entertainment format industry needs to develop more unique format factors especially in creative selection and combination of them.
