기술적 보호조치 무력화 금지의 예외

국문 초록

접근통제 기술적 보호조치의 무력화 금지에 대해서는 규칙제정에 의하여 예외가 인정된다. 곧 무력화 금지에 의하여 특정 종류의 저작물을 정당하게 이용하는 것이 불합리하게 영향을 받거나 받을 가능성이 있다고 인정되는 경우, 예외가 고시될 수 있고 이러한 예외의 효력은 3년이다. 접근통제 무력화의 예외를 규칙으로 설정하는 것은 저작권에 대한 예외와 무력화 금지에 대한 예외가 다르고, 이것은 저작권을 보호하는 규범인 저작권 입법과 저작물에 대한 접근을 통제하는 기술적 보호조치 입법이 다르다는 것에 기인한다. 한국에서는 2018년 2월부터는 새로운 고시가 발효되고 있는데(2021년 1월까지 유효), 이 고시는 무력화 금지의 예외로서 8가지를 규정하고 있다. 곧 영상물, 탈옥, 잠금해제, 전자적 어문저작물, 3D 프린터, 보안연구를 위한 예외, 차량 소프트웨어에 대한 예외, 비디오게임 등에 대하여 예외를 규정하고 있다. 이러한 예외의 유형은 저작권법이 규정하고 있는 저작물 유형과는 다소 구별되고, 예외가 적용되기 위해서는 여러 요건을 충족하여야 한다. 이 글은 2018년 고시에 포함된 무력화 예외와 관련된 여러 쟁점을 이론적으로 상세하게 고찰하기보다는 고시의 내용을 설명하는 데 초점을 맞추고자 하였다.

영문 초록

While it is prohibited to circumvent a technological measure that effectively controls access to a work protected under the Copyright Act, the Act provides some exceptions to anti-circumvention. Exceptions to anti-circumvention are as encryption research, law enforcement, reverse engineering of software, or protection of minors. Those exceptions are quite different from those of exceptions to copyright infringement, which results from the anti-circumvention legislation is different from copyright legislation. Exceptions to anti-circumvention is also provided through the rulemaking process. Those exceptions are effective only for three years, which means the rule needs to be made every three years. Korea has promulgated rules three times since the Copyright Act legislated anti-circumvention provisions. In January 2018, Korea promulgated the new rule which provides several exceptions to anti-circumvention. Those exceptions are motion pictures, electronic literary works, jailbreaking, unlocking, 3D printers, vehicle software, security research of vehicle software and video games. Exceptions to anti-circumvention through rulemaking may have much impact on technologies themselves and aftermarket products. When enacting the rule on anti-circumvention, it is quite necessary to take those into account. This paper examines exceptions to anti-circumvention of access control TPM newly provided under the Korea’s new 2018 rule. Rather than theoretically discussing legal issues related to anti-circumvention, this paper focuses on explaining those exceptions and their requirements for anti-circumvnention.
