경찰활동에 대한 외부기구의 통제: 평가 및 제언

국문 초록

이 글은 경찰활동에 대한 외부기구의 통제 필요성을 역설한 국내 선행연구들을 개관하고, 우리나라에서 경찰력 행사에 대한 외부적 통제가 어떻게 이루어져 왔는지를 실증적으로 확인하기 위해 국가인권위원회 및 국민권익위원회 백서에 나타난 경찰관련 진정 및 민원처리 현황을 분석하였다. 그 결과, 국민권익위원회는 2006년부터 경찰옴부즈만 기능을 수행해 왔음에도 장기간 운영에 따른 노하우가 축적되었다거나 경찰에 대한 외부적 통제기구로서의상이 강화되었다고는 해석할 수 없는 상황으로 판단되었다. 한편, 국가인권위원회의 상담 및 진정 통계 분석결과는 경찰 외에도 검찰·교정 등 외부적 통제를 요하는 형사사법기관이 더 있음을 보인다. 아울러 우리나라를 포함한 OECD 35개국의 경찰활동의 책임성과 투명성을 확보하기 위한 제도적 노력과 경향성을 살펴보면, 영국의 ‘독립 경찰민원 조사위원회’(Independent Office of Police Conduct), 그리고 OECD 국가 중 이를 각국의 상황에 맞게 받아들인 호주·노르웨이·스웨덴 등은 기관명에 ‘경찰’을 포함하고 있지만 통제 기능의 범위를 경찰만으로 한정하고 있지 않으며 기관의 역할과 권한 범위를 점진적으로 확대하여 왔다는 점이 확인된다. 이러한 검토를 바탕으로 경찰과 수사 영역을 중심으로 하되, 검찰·교정·특사경·사법기관까지 형사사법기관을 아우르고 국가인권위원회와 동등한 위상을 가지는 가칭 ‘형사사법위원회’를 설치할 것을 제언하였다.

영문 초록

In 2017, the National Police Reform Commission proposed the creation of a new civilian oversight institution as a way to prevent excessive use of coercive power by police. The article provides literature review that has stressed the need for independent oversight mechanism to control police activities; and an analysis of police-related petitions and appeals in the white papers of the National Human Rights Commission and the Anti-Corruption and Civil Rights Commission to assess empirically how external control over abuse of police force has been achieved in Korea. According to the analysis results, the Anti-Corruption and Civil Rights Commission has little know-how for police oversight accumulated in the Commission; furthermore, its status as an external oversight mechanism of police has not been established, even though the Commission has been performing the function as police ombudsman since 2006. The analysis results on consultations and appeals reviewed by the National Human Rights Commission indicate that there are more criminal judicial institutions that require democratic and independent oversight besides the police. The article, in addition, looks at institutional efforts and trends to ensure accountability and transparency in police activities in 35 OECD countries, including South Korea. Some OECD countries, such as Australia, Norway and Sweden, which have adopted the British police oversight mechanism, e.g. the Independent Office of Police Conduct, have not focused on the police solely, but have been expanding it to the complete context of the law enforcement system within a country. In this regard, the article suggests that the implementation of a tentatively named ‘Criminal Justice Commission’ should be considered in priority whose position is equivalent to the National Human Rights Commission and whose jurisdiction covers the whole criminal justice proceedings and organizations including prosecution and correction authorities.
