국문 초록

이 논문은 자치경찰의 수사를 중심으로 자치경찰제 설계 모델에 대해 검토한다. 이를 위해 수사권조정, 지방자치제, 경찰의 운영(효율성 v. 민주성), 제주자치경찰제와 자치경찰제에 대해 살펴봄으로써 자치경찰제의 필요성과 자치경찰제 설계의 방향에 관한 시사점을 도출한다. 또한 국가경찰제의 유지 v. 분산, 수사권을 중심으로한 사무배분, 국가수사본부와의 관계, 민주적 통제장치 등을 검토하고, 이를 토대로 자치경찰 수사의 관점에서 합리적인 자치경찰제의 설계 모델을 제시한다.

영문 초록

The purpose of this paper is to examine the design model of the Local Police System. First of all, check why the Local Police System is needed, through review redesign of Investigation System, local government, the operation of the police (efficiency v. Democracy), and Jeju Local Police System. Several issues with the Local Police System, maintenance of the national police system v. Decentralization and democratic control systems are reviewed, and based on this, the direction of the autonomous police design model is derived. The local police system can be designed as a dualization model, a semi-unification model, and an eclectic model depending on whether the national police system is maintained. It should be taken into account that the local police system should disperse the bloated police force at the present time. Therefore, the dualization model and the model of the Police Reform Committee, which have little effect of dispersion, should be excluded. The semi-unification model and the eclectic model of the Presidential Committee on Autonomy and Decentralization remain the subject of consideration. However, the level of political culture and local autonomy and Decentralization in Korea should be considered. At this point, if the local police have full powers of investigation, it must be concerned about whether they will be free from the influence of local political forces. In this regard, the semi-unification model should be left as the ultimate goal of the local police system. At this point, it is necessary to design a model that can be introduced, that is, a model of the autonomous decentralization committee.
