프랑스 행정절차법의 제정과 그 특징

국문 초록

우리 행정절차법의 내용은 독일법을 모델로 하면서도, 헌법 제12조에 따라 절차적 하자를 엄격히 새기는 판례의 입장을 보면 미국의 적법절차 원칙의 영향이 크다고 보인다. 그러나 프랑스의 경우, 미국과 동시대에 혁명을 겪은 공통점은 있지만 ‘절차적 실익’에 대한 인식과 제도는 매우 다른 모습을 보이고 있다. 프랑스의 경우 1789년 대혁명으로 민주적 정당성을 확보하고 독일식의 법치국가와는 다른 프랑스 나름의 법률국가(Etat de Droit)를 구축하며 프랑스 고유의 제도적 민주주의를 발전시켜 왔다. 즉, 프랑스는 영미법계의 국가가 아님에도 사실상 꽁세이데따에 의한 판례법에 의해 행정법이 형성되고 발달되어 왔는데, 사법부에 대한 불신으로 생겨난 꽁세이데따(Conseil d’Etat)는 행정의 한 영역으로 행정재판을 담당하는 행정법원으로써 행정에 대한 사후적·객관적 통제를 통해 법치행정을 구현해왔다. 그러나 1970년 후반의 절차적 민주성 관련한 일련의 입법에 이어 프랑스는 행정절차법의 제정에 꾸준히 관심을 가져왔는데, 실패를 거듭하면서 일부 학자나 또는 행정법원에서는 행정절차 분야는 그 본질상 종전과 같이 판례에 의해 발전되어야 한다는 확신을 남기게 되기도 하였다. 유럽연합차원에서도 행정절차법 제정이 박차를 가하는 가운데 마침내 2015년에 기존의 법령과 판례를 집대성화여 ‘공중과 행정과의 관계에 관한 법전’(Code des relations entre le pubic et l’administration)이 제정되었고 동 법전에 행정절차에 관련된 규정이 수록되어 있다. 따라서 이 법전을 행정절차에 관한 일반법으로 이해하고 있다. 본 연구에서는 프랑스에서의 행정절차 관련 법제 및 법리의 발전을 살펴보고 2015년에 제정된 행정절차법전의 주요내용 가운데 행정절차의 핵심 사항으로 이해되는 처분의 사전통지, 의견제출 및 청문, 처분의 이유제시, 공청회 등에 초점을 맞춰 그 특징을 검토해보고자 한다.

영문 초록

The contents of the Administrative Procedure Act in Korea, while modeled basically on German law, appear to be influenced by the U.S. principle of procedure in law, given judgment that strictly engrave procedural flaws under Article 12 of our Constitution. In France, however, there is something in common with the U.S. that went through the same revolutionary period, but the perception and system of ‘procedural real-life’ in them are very different. In the case of France, it has developed its institutional democracy in its own way by securing democratic legitimacy through the 1789 Great Revolution and establishing legal state in its mode in France, which is remarkably different from the German-style rule of law. In other words, even though France is not an English-American law state, administrative laws have been formed and developed by the Court of Justice by Conseil d’Etat, which was created by distrust or lack of confidence in the judiciary, have implemented the rule of law through hindsight and objective control over administration as an administrative court in charge of administrative decision on appeal. However, following a series of legislation on procedural democracy in late 1970 interests arose in France rather steadily in enacting the Administrative Procedure Act, which has led some scholars or members in the administrative court to the conviction that laws relating to the administrative procedures should be developed by precedents in nature. With the enactments of the Administrative Procedure Act developing widely at the European Union level, the Code on Relations between the Public and the Administration was finally enacted in 2015 by bringing together existing statutes and precedents, and the same Act contains provisions relating to administrative procedures. Hence, this Act is understood to govern administrative procedure as a general law and non-trial procedures as well in France. In the present paper, attempts were also made to put forward some preliminary observations on the legal developments of administrative procedures in France. This inevitably led to the discussions of the substantive features and the relevant backgrounds culminating in the enactment of the Administrative Procedure Act in 2015, It also needs to be pinpointed that other issues were dealt with, such as prior notice of disposal, responses and hearings, reasons for disposal, and public hearings among other aspects.
