국문 초록

헬스케어서비스는 보험회사가 보험계약자 등의 건강을 유지 관리하고 효율적 으로 치료하는데 반드시 필요한 업무로서 보험의 효용을 높이기 위해 적절하게 보장되어야 한다. 그러나 현재 실무적으로 보험회사가 보험계약자 등을 위해 충분한 헬스케어서비스를 제공하기에는 일정한 한계가 있다. 의료법상 의료행위 해석 문제, 의료정보 공유 문제가 핵심 사항이라 할 수 있다. 이러한 법적 쟁점과 관련하여 보건복지부 등 관련 부처에서 다양한 논의가 이루어지고 있다. 그런데 아직까지 가시적인 효과는 없는 상황이며, 향후에도 의료계의 반대로 인해 전향적인 유권해석 및 법령개정 등도 불투명하다. 다만, 최근에 빅데이터 경제 3법의 개정 움직임이 있고, 마이데이터 산업과 관련된 정부의 정책 발표가 있기에 개인정 보의 활용이 절실한 보험업 등 빅데이터 관련 산업의 가시적인 발전이 기대된다. 궁극적으로 효율적인 치료를 위해서는 의료진이나 정보주체가 의료정보에 접근하여 활용할 수 있는 방안이 강구되어야 한다. 먼저 국가 차원의 의료데이터 통합 관리 체계가 우선적으로 이루어지 고, 정보주체가 자신의 의료정보를 치료 등의 목적으로 이용할 수 있도록 데이터 관리체계가 수립되어야 한다. 이에 따라 빅데이터 경제 3법을 통활 할 수 있는 통합 빅데이터법을 제정 하거나 개인의료정보 보호 및 활용법 제정을 통해 철저한 보안이 전제된 정보공유와 정보결 합을 확대하고, 아울러 법체계상의 문제도 보완할 필요가 있다. 특히 보험업과 관련하여 개인의료정보를 헬스케어서비스의 선진화에 활용할 수 있도록 정보 관리, 접근 또는 열람, 활용 시스템을 보험업계의 보험정보통합시스템과 연계할 수 있는 방안이 강구된다면, 보다 수준 높은 서비스가 가능하리라 생각한다. 그러나 보험업계가 갖고 있는 정보관리체계에 국민건강관리공단 등이 보유하고 있는 개인의료정보를 결합하는 것은 기술적으로 가능할지 라도 정보의 오남용과 같은 문제로 인해 실현 가능성은 높지 않다. 정보주체가 정보관리자로 부터 자신의 민감정보를 모바일앱 등을 통해 직접 받아 본인의 동의하에 헬스케어서비스 등에 활용하는 방안이 적절하다고 본다.

영문 초록

Healthcare service is essential for insurance companies to manage and keep a policyholder’s health and for the efficient treatment. It should be guaranteed properly in order to increase insurance usefulness. Unfortunately, insurance companies face some limitations in providing enough healthcare service for a policyholder in a practical level. The main limitations are interpretation of medical behavior according to Medical Service Act and sharing of health records. With regard to the legal issues, Ministry of Health and Welfare and other relevant government departments have a variety of discussion. However, any visible effect has yet to be produced. It is still unclear that forward-looking authoritative interpretation and legal revision will be made, due to the opposition of the medical circle. Nevertheless, given the three acts of big data economy to be revised and the government’s announcement of MyData industry, the big data based industries, including the insurance industry that urgently need the use of personal information, are expected to achieve visible development. Ultimately, for efficient treatment, it is necessary to find a plan that helps the medical staff or information objects access and use medical records. In other words, it is necessary to establish a health data integration and management system in the national dimension, and to make a data management system that helps information objects use health records for treatment. Accordingly, it is necessary to establish the act of integrated big data which embraces the three acts of big data economy in order to address legal issues. In particular, if an information management, access, and utilization system interacts with the insurance information integration system in the insurance industry in order for insurance companies to apply personal health records to their healthcare service advancement, better service will be provided. Although the information management system of the insurance industry can technically combine with the personal health records managed by National Health Insurance Corporation, it is less likely to be implemented due to abuse of information. Therefore, the proper plan for utilizing healthcare service is to let information objects directly receive their sensitive data from an information manager through mobile app and then agree on the use of their data.
