보험업 분야에 있어서 블록체인의 활용과 법적 쟁점

국문 초록

최근 ICT 기술 발전으로 핀테크의 한 유형인 블록체인 기술이 보험과 헬스케어등 다양한 분야에 적용되고 있다. 블록체인은 중앙서버를 통하지 않고 고객과 금융회사간의 직접 거래 방식에 기반하기 때문에 수수료 등 거래 비용의 절감, 업무처리 시간의 단축, 분산원장 시스템에 의한 안전성 확보 등의 장점이 있다. 이에 각국의 금융회사들이 블록체인 시스템 구축에 적극으로 나서고 있다. 그런데 블록체인 기술이 보험거래 과정에서 다양하게 이용되면서 종래 예상하지 못했던 새로운 형태의 법률적인 문제가 생길 수 있다. 이 연구에 서는 블록체인 기술을 보험산업 분야에서 활용하는 과정에서 파생할 수 있는 법적 쟁점으로, 스마트계약의 법적 성질 문제, 보험사기 방지 문제, 경쟁법적 문제, 금융정보보호 문제, 보험 소비자보호 문제 등을 검토하고, 현행법 체계의 틀 속에서 이를 어떻게 규율할 것인가에 대한 해석론을 제시하였다.

영문 초록

Due to the recent development in ICT technologies, blockchain technology, which is a type of fintech, is being applied in various fields including insurance and health care. Because blockchain is based on direct transaction methods between customers and financial companies, instead of using a central server, it has the advantages of cutting on transaction costs such as fees, shortening work processing time, and procuring safety through a distributed ledger system. Accordingly, financial companies around the world are actively looking to construct a blockchain system. However, with blockchain technology being used in various ways in the insurance transaction process, they may be new, unexpected types of legal issues. As legal issues that could sprout from the course of using blockchain technology in the insurance industry, this study reviews issues on legal character of smart contracts, issues on preventing insurance fraud, legal issues on competition, issues on financial information protection, and issues on insurance consumer protection, etc. In addition, it suggests a methodology on how to regulate this in the current legal system.
