국문 초록

2018년에 불거진 사립유치원 회계부정에 관한 비리 사태로 사립유치원의 회계의 투명성을 제고함으로써 유아교육의 공공성을 강화해야 한다는 주장이 제기되고 있다. 유치원과 어린이집의 비리와 도덕적 해이에 대한 우려와 대책 마련의 필요성이 있고, 비리 사태를 계기로 우리사회는 국가 또는 지방자치단체의 예산이 사용되는 곳에서 관리·감독이 적재적소에 이루어지고 부패와 부정을 방지해야 한다는 행정 공개의 중요성을 다시 들여다보는 것이 의미가 있는 시점이다. 이에 본고에서는 유치원 및 어린이집의 행정 정보공개 제도의 현황과 문제점을 짚어보면서 행정 정보공개·공표 제도와 관련된 헌법상 근거와 행정법상 쟁점 등 공법적 측면에서 검토하고 거시적으로는 지방정부와 중앙정부, 민간의 영역을 아우르는 위원회 거버넌스를 정보 공개 제도와 관련하여 중점적으로 검토하여 보기로 한다. 이로써 향후에 유치원 및 어린이집 행정 감독 관련 정책 개선 논의가 있을 때 뒷받침할 수 있는 공법적 토대를 제공하고, 현행 관련 정책들에도 의미 있는 통찰을 제시하였다. 회계 정보를 포함하여 정보 공개를 통한 행정의 투명성 확보는 궁극적으로 국민들에게 필요한 정보를 제공하여 행정에 직간접적으로 참여할 수 있는 기반을 제공한다는 민주주의적 측면과 국민의 기본권 보장을 추구한다는 면이 있다. 이로써 행정기관 행정 작용의 신뢰성을 확보하고 행정기관 스스로가 정보의 제공을 위한 사전작업을 통해 자체적인 지정 작용과 부패 방지를 할 수 있는 기회가 된다는 다기능을 가지고 있다. 현재 어린이집과 유치원에 각각 달리 규율되고 있는 법령들의 기준과 그 적용은 개선될 필요가 있고, 통합적으로 규율·운영될 수 있는 여지가 있는지 면밀한 분석·검토를 통해 지속가능하며 운영 목적에 적합한 규율로 정비되어 나아가야 할 것이다. 위원회와 같은 참여형 거버넌스를 활용하여, 일회적인 논의가 아닌 이해관계자들이 모두가 머리를 맞대고 중장기적인 논의를 계속 할 수 있는 방안을 모색해야 한다.

영문 초록

The corruption of private kindergarten accounting fraud in 2018 suggests that public kindergarten education should be strengthened by enhancing the transparency of private kindergarten accounting. There is a need to raise concerns and countenneasures against corruption and moral hazard in kindergartens and Pre-kinder. It is important at this point to look again at the importance of administrative disclosure to prevent fraud. This paper examines the current status and problems of the public information disclosure system of Kindergartens and Pre-kinders, and examines the public law in terms of the constitutional basis and administrative law issues related to the public information disclosure and publication system. Committee governance across the private sector will be reviewed in relation to the system of infonnation disclosure. This provides a public legal basis to support future policy discussions regarding administrative supervision of Kindergartens and Pre-kinders, and provided meaningful insights into current policies. Securing transparency in government administration through disclosure of information, including accounting information, seeks to ensure the fundamental rights of the people and the democratic aspect of ultimately providing the people with the information they need to provide direct and indirect participation in administration. As a result, it has the multifunctionality that it is possible to secure the credibility of the administrative functions of administrative agencies and to provide their own self-cleaning and anti-corruption through the preliminary work for the provision of information. The standards and application of laws that are currently regulated differently in Pre-kinders and Kindergartens need to be improved which should be maintained. Using participatory governance, such as committees, we need to find ways for stakeholders to keep everyone together and continue the mid-term to long-term discussions, rather than one-off discussions.
