국문 초록

본고는 정밀의료의 실현에 있어서 넘어야 하는 큰 과제인 데이터 거버넌스의 문제에 대하여 미국이 대응하고 있는 방식을 고찰한 연구이다. 정밀의료의 개념을 설계한 미국은 현재 연방정부의 주도하에 All of US Research Program이라는 정밀의료 코호트 연구사업을 추진 중에 있다. 본고에서는 미국의 이 연구사업을 사례연구의 대상으로 삼아 미국에서 정밀의료를 위한 데이터 거버넌스를 구축해 나가는 방식, 그 주요 내용 및 구축과정을 이끌어가고 있는 관련 이해관계자들이 상호작용하는 양상을 조명하고, 이 내용에 기초하여 국내 정밀의료 연구사업의 데이터 거버넌스와 관련 규범 및 정책에 대한 실천적 시사점을 제언하였다. 구체적으로 본고에서는 미국의 정밀의료 연구사업을 개괄한 후, 데이터 거버넌스의 구축 과정과 주요 내용을 데이터 거버넌스의 지도원리, 동의제도, 데이터의 수집, 데이터베이스의 구축, 데이터의 접근ㆍ공유ㆍ이용, 데이터의 폐기, 상호운용성에 관한내용을 중심으로 검토하였다. 중요성이 높은 프라이버시 및 데이터 보안에 관한 규제 체계는 별도의 절에서 다루고, 결론에 갈음하여 이 사례 연구가 국내에 시사하는 바를 실무적, 제도적, 조직적 관점으로 나누어 제언하였다.

영문 초록

This article addresses the data governance issues in the precision medicine. It closely examines the U.S. approach, in particular, in the All of US Research Program. The All of Us Research Program, previously known as the Precision Medicine Initiative Cohort Program, is a research program created in 2015 during the Obama Administration that aims to make advances in tailoring medical care to the individual. This article intends to highlight the building process of the data governance, its key features, and the interactions among relevant players leading the process. and, therefrom draw some practical implications for the our own precision medicine initiative. To this end, this article first explains the general overview of the All of US Research Program. Next it examines the process of establishing the data governance and its main contents in the order of the guiding principles, informed consent, data collection, databases, data access, share and use, data disposal, and interoperability. The regulatory frameworks for privacy and data security are discussed in a separate section. In the final section, it provides some practical, institutional and organizational implications and suggestions for the Korean precision medicine initiative.
