<론문(論文)> : 민주주의 교육과 교육법제 -한국과 독일의 비교를 중심으로-

국문 초록

이 글은 한국 민주주의 교육의 문제 상황의 원인이 민주주의 교육 정책을 담는 그릇 인법제에 있다고 인식하고 한국 민주주의 교육을 위한 법제의 현황과 문제점을 분석하고 그 개선 방안을 제시하는 것을 목적으로 하였다. 이러한 목적을 달성하기 위하여 2 차 세계 대전 전후의 독일의 교육 개혁과 민주주의 교육을 위한 법제 정비 현황을 고찰 하였다(Ⅱ). 그리고 2차 세계 대전 전후와 현재에 이르기까지 한국의 교육 개혁과 민주주의 교육을 위한 법제 정비 현황을 고찰하였다(Ⅲ). 이에 기초하여 독일과 한국의 민 주주의 교육을 위한 법제를 비교하고, 우리 헌법과 해석론에 기대어 현행 한국 민주주의 교육법제의 문제점을 짚고 그 개선 방안을 제시하였다(Ⅳ). 필자는 한국의 교육법제에서 민주주의 교육을 위한 법제가 본질성 이론과 의회 유보 원칙, 헌법 제31조 제4항, 헌법 제31조 제6항에 부합하지 않는 위헌적인 상황이라고 주 장하였다. 그리고 「교육기본법」 제2조의 표현을 정비하여 민주주의 교육이 우리의 교 육목표임을 좀 더 분명하게 규정하도록 권고하고, 「교육기본법」 제3장에서 국가와 지 방자치단체가 민주주의 교육에 필요한 시책을 수립.실시하도록 책무를 부여하는 규정을 신설할 것을 제안하였다. 나아가 「초.중등교육법」에서는 이러한 민주주의 교육을 구 현하기 위한 구체적인 구현 방안을 규정하는 것이 타당하다고 결론지었다. 이러한 규정 형식에 있어서는 독일 바덴-뷔템베르크 주, 노트라인베스트팔렌 주, 헤센 주의 헌법과 학교법을 참고하도록 제안하였다.

영문 초록

This article aims to analyze issues of legislation on democracy education and to suggest the improvement plan in Korea. For this purpose, the revision status of the legislation on education reform and democracy education of German post-war World War II was examined(II). Im addition, the revision status of the legislation on education reform and democracy education of Korea from World War II to the present was examined(III). In comparing the legal basis for democracy education in Germany and Korea, this article pointed out the problems of the current legislation of democracy education and suggested the improvements(Ⅳ). After World War II, democracy education became a goal of school education in West Germany for the purpose of Denazification, and social studies began to be introduced as a key means of achieving the goal. These education policies are stated in the Constitution(Verfassung) and School Law (Schulrecht) in the form of law(Gesetz) of the state(Lander). On the other hand, the Constitution of Korea does not explicitly provide democracy education. The article 2 of the Framework Act on Education of Korea provides that education shall aim at enabling every citizen to lead a life worthy of humankind and to contribute to the development of a democratic state and the realization of an ideal of human co-prosperity, by ensuring cultivation of character, development of abilities for independent life and necessary qualities as a democratic citizen under the humanitarian ideal. However, practical implementation scheme is not specified in the Framework Act on Education, the Early Childhood Education Act, the Elementary and Secondary Act, etc.We thought that the status of education legislation does not comply with the article31 of the Constitution which provides that fundamental matters pertaining to the educational system, including in-school and lifelong education, administration, finance, and the status of teachers shall be determined by Act. Therefore this article concluded that democracy education is a goal of school education and that practical implementation scheme to be defined in the form of law by the National Assembly. More specifically, the revision the article 2 of the Framework Act on Education for defining more clearly that the democracy education is a goal of school education, and the introduction of new provisions which impose the obligations of preparing policies for democracy education to the government and local government are recommended. In addition, in the Elementary and Secondary Education Act, specific implementation measures for democracy education are needed. This article listed the Constitution and education legislation of Baden-Wuerttemberg, Nordrhein-Westfalen and Hessen in Germany for the reference.
