지방자치단체의 장학숙 제도에 관한 법적 문제점

국문 초록

지방자치단체의 장학재단 설립이 붐을 이루고 있다. 지역인재 육성을 위한 장학제도를 마련하는 것은 중요한 것이지만 장학재단의 설립·운영에서 여러 가지 문제를 드러내고 있다. 특히 장학제도가 수도권 소재 대학에 재학중인 학생들에 대한 지원에 치중하고 있어 지방자치단체가 역할에 부합하는 것인지 의문이다. 또한 장학숙이 입사자격이 성적을 중시하고 있으며 2년제 대학 재학생을 배제하는 경우가 많다. 이는 평등권 침해의 차별행위라고 할 수 있다. 지방자치단체에서 건설하는 수도권 소재 장학숙은 그 건설과 운영에 적지 않은 비용이 소요된다는 점에서 지방자치단체의 예산집행에서 매우 신중하여야 한다. 이는 지방자치단체나 장학재단의 예산집행이 서울지역 대학생에 대한 지원에 초점이 맞춰지는 꼴이다. 기숙사 입주 대상자가 주로 서울·인천·경기 지역 대학생들이고 오히려 지방자치단체 소재 지역에 거주하는 학생들에게는 혜택이 부여되지 않는 것은 공정하지도 합리적이지도 않다. 차별취급에 합리적 이유가 없으므로 평등권 침해라고 평가될 수 있다. 아울러 지역인재가 무엇인지에 재검토가 필요하다. 중요한 것은 지금 여기 살고 있는 사람이고 이들의 복리증진과 삶의 환경 개선이 무엇보다 중요한 지방자치단체의 사무가 되어야 한다. 수도권에서 공부하는 데 많은 비용이 드는 것은 사실이지만 이 문제의 해결은 지방자치단체보다는 국가가 하거나 사적 부분에서 해결할 문제이다. 성적만으로 인재를 평가하는 것은 문제도 많으며 이렇게 양성되어 다른 지역에서 생활하게 될 인재가 지역에 도움이 얼마나 되는지도 의문이다. 사고방식이 스스로 서울지역에 종속되어 있는 것은 아닌지 돌아볼 필요가 있다.

영문 초록

The financial aid program has the goal to help make education accessible to every student, especially for those with low income. The scholarship or the grant by the local governments meets the needs of the students or their parents, because the promotion of the educational welfare is one of the goals of the local autonomy. Some local governments establish and operate dormitories for the students who study at the universities in the capital city(Seoul) area. It aims to alleviate the tuition burden of the students or their parents who reside in the local area, because the expense for the education including tuition fee, boarding expenses, etc. to study in the capital city area is somewhat burdensome. But the scheme of the financial support programs carried by some local governments has some legal problems. First, it violates the equal rights of the 2-year-course college students to disqualify the right to apply for the dormitory established by the local government. There is no rational basis to exclude the 2-year-course college students, nor treat the 4-year-course college students preferentially. Second, it contradicts the ideal of the local autonomy to grant most of the fund raised by the local government to the students, who don``t reside in the local area. The residents should have priority over the non-residents. Third, the amount of the grant for the non-resident students occupies the greater part of the scholarship fund. To increase the effect of the grant, the financial aid should be focused on the resident students.
