교육권의 기본원리에 관한 소고

국문 초록

우리나라 헌법 제31조 제1항은 “ 모든 국민은 능력에 따라 균등하게 교육을 받을 권리를 가진다” 라고 해 교육을 받을 권리를 헌법상 권리로 인정하고 있고 동조 제2항에서는 교육을 받을 의무를 규정하고 있다. 헌법이 정한 교육을 받을 권리는 국민이 능력에 따라 균등하게 교육을 받을 수 있도록 국가가 적극 배려해 줄 것을 요구할 수 있는 권리를 의미한다. 교육을 받을 권리는 자연인인 개인이 각기 인간으로서 존엄과 가치를 실현함에 있어 불가결하게 요구되는 교육을 받을 수 있게 하는 것을 헌법상 권리로 보장한 것이다. 본고에서는 교육권의 개념과 이론을 비롯해 기본원리가 되는 자주성, 전문성, 정치적 중립성의 원리를 살펴보고자 한다. 향후 이러한 주제에 관한 논의가 더욱 활성화됨으로써 우리 경제발전에 견인차 역할을 해 왔던 교육에 관한 논의가 더욱 활발해 졌으면 하는 바람이다.

영문 초록

The South Korean constitution grants the right to receive the education equally according to the capability and prescribes the obligation to get the education. The right to get the education which the constitution determines means that the right is the one for the people to demand on the country that everyone should be educated according to the capability equally in order to get the education. The right to get the education guaranteed by the constitution is the right to get the education which is indispensable for the natural person and to facilitate to realize the dignity and value as the human respectively. In this manuscript, as a solution for the crisis of the university because of the degradation of the population of children the basic principles of the educational right of were emphasized. I hope much more concrete studies be proceeded concerning the education which had been performing the helpful role in our economic development.
