국문 초록

교수 임용 등 인사권의 문제, 학교 재정관리 문제 등은 교수의 교육·연구 활동 및 대학의 자율성·전문성 보장과도 직결된 중요한 사항이므로, 이러한 문제에 대하여 공익적 목적으로 비판하는 것은 허위사실에 근거한 의도적인 공격이 아닌 한 헌법상표현의 자유로서 최대한 보장되어야 한다. 또한, 대학교수가 집단행위 금지의무나 품위유지의무 또는 성실의무 등에 위배되지 않는 범위 내에서 공익적 목적을 위해 평화적인 방법으로 진행 중이던 시위를 중단하라는 대학 총장의 지시는 정당한 직무상의 명령이라고 보기 어려워, 그 지시를 따르지 않았다 하더라도 그것이 직무상의 명령에 복종하여야 할 의무를 위반한 행위로 볼 수 없다. 이러한 취지가 적극 반영된 이번 D대학교 교수협의회 사건 판결은 대학총장에게 교무통할권이 집중된 현행 고등교육법 하에서 대학의 자치를 실현할 수 있도록 대학 내에서의 표현의 자유를 최대한 넓게 해석했다는 점에서 의미 있는 판결이다.

영문 초록

Problems such as appointment of professors and personnel rights, school financial management issues, etc. are important matters directly linked to the teaching and research activities of the professor and the autonomy and specialization of the university. As long as it is not intentional attack based on false facts to criticize for the purpose of public interest, it should be guaranteed as maximum freedom of constitutional expression. Also, in order to stop the demonstration which was in progress in a peaceful way for public benefit purposes within the limits of the number of universities not obliging collective actions, duty of maintaining quality or honesty obligation etc., the university president Instructions are hard to see as legitimate duty orders and even if they do not obey the instructions, they can not be seen by acts that violate the obligation to obey their duty order. In the case of the D University Professor Council incident this time that the purpose was positively reflected in this case, the judgment ensured that under the current higher education law under which he right to control academic affairs is concentrating to the university president, the autonomy of the university can be realized, It is a meaningful judgment in that it interpreted the freedom of expression within the university as widely as possible.
