독일 교육법 연구의 동향과 특징

국문 초록

지난 10년 동안의 독일 교육 관련 법제 변화의 주요 특징과 동향은 다음과 같은 네 가지 정도로 요약될 수 있다. 첫째, 연방의 교육 관련 입법형성권 영역의 축소와 주의 교육 관련 입법형성권 영역의 확대이다. 둘째, 학교법 영역에서의 학교자치의 확대를 들 수 있다. 셋째, 대학법 영역에서 대학참사회 내지 대학이사회 중심의 대학 거버넌스의 유지를 들 수 있다. 넷째, 볼로냐 프로세스로 인한 대학법 영역에서의 유럽통일적 학위체계의 정비를 꼽을 수 있다. 이런 경향에도 불구하고 특히 대학법 영역에서 대학 거버넌스 구조의 기본 틀이 집단관리 대학(Gruppenuniversitat)에서 이(참)사회관리대학(Rateuniversitat)으로 안정적으로 정착되어갈지의 여부는 여전히 관심을 가지고 관찰해야 할 과제이다. 또한 2016년 2월 연방헌법재판소의 소위 `대학인증평가판결`을 통해 유럽 공통의 볼로냐 프로세스 진행에도 독일식의 법적 담보가 확보되게 되었다는 점도 유의할 점이다. 따라서 교육법 영역에서 유럽통합정책과 독일식 법적 통제와의 갈등과 조화의 방향성도 관심의 대상이다. 그밖에 교육복지정책과 함께 학교법 영역에서 독일로의 이주자 및 난민 자녀들에 대한 연방과 주의 학교교육 책무성 수행을 위한 협력적 정책들도 우리에게 시사하는 바가 있다. 독일의 교육법 연구의 지난 10년 동안의 동향도 전문잡지인 RdJB와 WissR에 의하면 큰 틀에서는 이런 특징과 경향과 관련한 교육법 개정 내지 개혁에 관한 제도와 법적 문제점들을 중심으로 다루고 있다고 평가할 수 있다. 그에 반해 유럽교육법및정책학회인 ELA는 유럽 차원의 주제 그리고 더 나아가서는 교육법 및 정책에 관한 세계적 공통 관심사들을 다루고 있다.

영문 초록

The major features and trends of German education legislation over the past decade can be summarized as four levels. First, it narrowed the scope of federal legislation on education and expanded the scope of the legislative power of states. Second, the expansion of school autonomy in the area of school law. Third, in the area of university law, the maintenance of university governance centered on “Hochschulrat“ or ”Stiftungsrat” can be cited. Fourth, the Bologna process can be regarded as the development of a unified European system in the area of university law. Despite this tendency, it is still a matter of interest to observe whether the basic framework of university governance structure in the university law area is steadily settled from the “Gruppenuniversitat“ to ”Rateuniversitat“. It is also worth noting that in February 2016 the so-called `University Accreditation Judgment` of the Federal Constitution Court secured German legal guarantees for the Bologna process in Europe. Therefore, in the area of education law, the direction of conflict and harmony with european integration policy and german legal control is also of interest. In addition to educational welfare policies, we also suggest cooperative policies for the implementation of federal and state school education accountability for immigrant and refugee children in Germany in the area of school law. The trends of educational law research in Germany over the past decade can be judged by the special journals RdJB and WissR, focusing on the institutional and legal issues related to education law related to these features and trends in the big frame. On the other hand, the European Association for Education Law and Policy, ELA, addresses global issues of european concern in education law and policy.
