학교 내 전자기기의 사용제한과 교육 평온성의 보호

국문 초록

디지털기술의 진보는 학생들의 삶 곳곳에 스며들고 있다. 대부분의 학생들은 휴대폰을 비롯한 각종 전자기기를 늘 휴대하고, 타인 또는 인터넷과 24시간 연결되어 있다. 이처럼 전자기기는 정보접근에 대한 항시성을 보장해 주고, 자신의 의사를 표현하는 데 필수적인 재화로 자리잡았다. 하지만 스마트폰 등 전자기기는 교육활동을 때때로 방해하거나 혼란을 야기하기도 한다. 각 학교는 디지털시대에 발맞추어 각종 전자기기의 사용과 효용법을 교육시키기도 하지만, 교육활동의 평온성을 보호하기 위하여 그 소지 및 사용을 제한하기도 한다. 학교가 헌법을 비롯한 법령 등에 근거하여 학생들의 휴대폰 등 전자기기의 소지 및 사용을 제한할 때 다양한 기본권과 헌법적 이익의 제한이 동반된다. 그러므로 학교는 휴대폰 등의 소지 및 사용을 제한할 수 있는 교칙 등을 제정ㆍ시행할 경우 헌법이 요구하는 기본권 보장과 비례의 원칙을 준수하여야 한다. 이 글은 학교 내 전자기 등의 규율근거와 그 현황을 분석하여, 실제 교육현장에서 어떠한 기준과 원칙에 따라 교육적 조치가 수반되어야 하는지를 다루고자 한다. 입법자는 교육 관련 법령 등에 보다 체계적으로 전자기기 등의 소지와 사용에 대한 근거를 마련하여야 하고, 학교는 그로부터 학생들의 기본권과 교육활동의 평온성 보호라는 두 가치가 조화롭게 공존할 수 있도록 뒷받침하여야 한다. 거스를 수 없는 디지털세계로 진보하고 있는 현대에 교육영역은 기계와 공존할 방안들을 규범적으로 진화시킬 의무를 지고 있다.

영문 초록

The advances in digital technology have penetrated into the lives of students. Most students carry mobile phones and other electronic devices all the time. And they are connected online or to each other almost all the time. As such, electronic devices have become essential goods for ensuring the consistency in information access and for expressing their opinions. However, electronic devices including smart phones often interfere with classes and activities in school. On the one hand, schools educate the use and utility of various electronic devices in line with the digital age, but on the other hand, they limit the possession and use of digital devices in order to protect educational tranquility. When schools restrict students possession and use of electronic devices on the basis of constitutional law and other laws, it is accompanied by restrictions on various basic rights and constitutional interests. Therefore, schools should comply with the basic rights and the proportional principles required by the Constitution when they enacted or enforced school regulations that would restrict the possession and use of electronic devices including mobile phones. The purpose of this article is to analyze the present condition and basis of the discipline of electronic devices in school and to discuss what standards and principles of educational action should be followed in actual education field. Legislators should provide a basis for the possession and use of electronic devices more systematically in educational laws and regulations. Based on them, schools should support the harmonious coexistence of the two values of students basic rights and the tranquility protection of educational activities. In the modern era, which is moving towards an irreversible digital world, the education sector has a duty to evolve normative ways to coexist with machines.
