교육감의 지방자치단체 대표권에 관한 고찰

국문 초록

이 연구에서는 교육감이 시·도의 교육·학예에 관한 사무를 대표하고 있다고 볼 수 있는지를 검토하였다. 학계의 다수는 교육감이 시·도의 교육·학예 사무를 대표한다고 이해하고 있다. 그러나 엄밀한 의미에서 「지방자치법」을 비롯한 관계 법령의 규정이 이를 분명히 하고 있지 않다. 「지방교육자치에 관한 법률」 제18조에서는 “교육감은 교육·학예에 관한 사무로 인한 ‘소송이나 재산의 등기 등에 대하여’ 당해 시·도를 대표한다.”라고 하면서 ‘소송이나 재산의 등기’라는 단서를 제시하고 있다. 아울러 시·도의 통할대표권을 지니는 지방자치단체의 장은 교육·학예 사무로부터 완전히 분리될 수 없다. 불명한 교육감의 대표권을 전제로 중첩되는 사무에 대하여 이견이 존재해도 해결할 수 기제 역시 분명하지 않다. 이에 향후 지방분권과 자치가 확대되는 시대에 시·도의 교육·학예에 관한 사무 역시 자치권이 확장될 경우 현행 법령상의 교육감의 실효적 대표권에 대하여 우려가 제기되는 바, 이에 대한 대안과 향후 연구 과제를 모색하였다

영문 초록

In this study, I checked that a superintendent of education can represent a office work about Education, Art and Science of a local government. It is widely understood by the majority of the academic world that ‘Superintendent of education are representatives of about Education, Art and Science of the local governments’. However, strictly speaking It is not clearly marked in the related rules including the Local Autonomy Goverment Act. The article 18 of the Local education autonomy Act shows “Superintendents of offices of education shall represent a relevant City/Do ‘for lawsuits or the registration of property’ caused by the scope of affairs for Education, Art, and Science”. Under this clause, it contains a clue that is ‘for lawsuits or registration of property’. In addition, a local government head with general supervision over its affairs cannot be completely inseparable from the office work concerning Education, Art and Science. On the premise that a superintendent of education has an obscure authority, there is not a clear dispute settlement mechanism about overlapped controls. In the wave of decentralization around South Korea, there is a raising concern for an effective representative of superintendents of education. On this account, I have looked for alternatives and future research tasks about this.
