북한의 재난관리 법제에 대한 고찰

국문 초록

국경을 초월하여 발생하는 재난의 특성상 재난관리 체계는 국제사회의 보편성이 적용되는 분야로서 재난관리체계, 용어 등에서 유사한 체계로 발전해왔다. 구체적으로 살펴보면 1980년대 이래로 재난의 ①예방(mitigation or prevention), ②대비(preparedness), ③대응 (response), ④복구(recovery)의 4단계 체계가 통용되고 있다. 북한 역시 2010년대 들어 적극적으로 국제사회와 교류하며 재난관리 법제를 정비하고 국제사회의 기준을 받아들이고 있다. 그리고 2014년 6월 27일 재난관리 분야에 관한 기본법이 라고 할 수 있는 재해방지 및 구조 복구법 을 제정하여 재난관리 4단계 체계의 기본 개념을 어느 정도 받아들였다. 우리 역시 1995년 재난관리법 제정과 특히 2004년 재난 및안전관리 기본법 제정을 통해 국제사회의 재난관리 4단계 체계를 명확하게 받아들이고 이를 토대로 행정체계를 정비한 바 있다. 그 결과 남북한의 재난관리 법제의 기본 틀이 유사 해지고 있다. 이렇게 재난관리 분야는 북한이 국제사회의 공통적인 입법 흐름을 반영하여 새롭게 국내 입법을 한 대표적인 사례로서 향후 북한의 개혁 개방시 국제사회와의 협력의 중요한 사례가 될 수 있다. 또한 재난관리 분야는 이미 2000년대 이후 임진강 수해방지 공동조사단을 구성하기로 합의하는 등 남북간에 교류협력 경험이 있는 비정치적인 분야로서 향후 남북법 제분야 교류협력의 가능성이 높은 분야이기도 하다. 무엇보다 남북 상호간의 재난에 대한 공동대처와 협력의 경험은 70년이 넘는 분단에 따른 남북 주민간의 심리적 거리감을 해소 하고 공동체성과 연대의식을 형성하는 데 큰 도움이 될 수 있다. 이러한 점에서 북한의 재난관리 법제에 대한 연구의 의의는 매우 크다. 앞으로 재난관리 전문가, 법제 전문가, 북한 전문가들의 협업을 통해 북한 재난관리 법제의 정비 및 남북 재난관리 체계의 공동발전을 위해 더욱 관심을 가지고 노력할 필요가 있다.

영문 초록

Due to the nature of disasters that transcend national borders, the disaster management system is a field to which the universal concept of international society applies. For this reason, similar systems have been developed in management systems and terms. Since the 1980s, a four-step system of disaster prevention, preparedness, response, and recovery has been widely used. North Korea has also actively exchanged with the international community in the 2010s, has been improving the disaster law system and accepting international standards. On June 27, 2014, North Korea enacted the ｢Law on the Disaster Prevention, Relief and Recovery｣ , which is the basic law on disaster management, to some extent accepted the basic concept of the 4th stage disaster management system of the international community. South Korea also enacted ｢the Disaster Management Act｣ in 1995 and established ｢the Framework Act on the Management of Disaster and Safety｣ in 2004, clearly recognizing the 4th level disaster management system of the international community and improving the administrative system based on this. As a result, the basic framework of the disaster management laws of the two Koreas is becoming similar. On the other hand, the disaster management field is a representative example of North Korea s new legislative process reflecting the common legislative trends of the international community, and can be an important field of cooperation with the international community if North Korea is reformed and opened. In addition, the disaster management field is a non-political field which has high possibility of exchange and cooperation with the experience of exchanges and cooperation, such as the settlement of the Imjin River flood prevention joint investigation team since 2000. The experiences of joint action and cooperation on the disaster between the two Koreas can be a great help to resolve the psychological distance between the two Koreas and to form a sense of solidarity. In this regard, the study of North Korea s disaster management legislation is significant. In the future, it will be necessary to pay greater attention to the improvement of the North Korean disaster management legislation system and the joint development of the inter-Korean disaster management system through the cooperation of disaster management experts, legal experts, and North Korean experts.
