성매매 산업의 현실 그리고 현실개선방안에 관한 소고(小考)

국문 초록

2004년 9월 23일 성매매방지특별법이 시행되었다. 성매매방지 특별법의 시행을 위하여 각계각층의 꾸준한 노력이 있어왔다. 그럼에도 불구하고 진척이 크게 없었던 성매매방지 특별법의 시행에 가장 결정적인 계기가 된 것은 군산 대명동 화제사건이었다. 2000년 9월, 군산 대명동 사창가에서 화재가 발생하여 5명의 여성이 사망하였다. 이 여성들은 거주이전의 자유를 박탈당한 가운데 가혹한 성매매에 시달려 왔고, 화재가 발생했을 당시에도 잠금 장치로 인하여 밖으로 탈출이 불가능한 상황이었다. 이러한 현실이 사회로 알려지면서 현실개선을 위한 조치가 필요하다는 인식이 확산되었 고, 2002년 9월 조배숙 의원 외 86명의 발의로 법이 상정되었다. 그리고 2004년 9월 23일 드디어 성매매방지특별법이 시행되었다. 많은 이들이 이 법의 시행으로 성매매산업이 사라지지는 않더라고 성매매산업을 위축시킬 것이라는 기대를 하였다. 그러나 법 시행 후 10년도 더 지난 2016년, 우리나라의 성매매산업은 법 시행시의 기대 와는 달리 각종 성매매가 더욱 활성화된 사회가 되었다. 신종 성매매산업이 언론을 통해 기사화되고, 동남아, 동유럽, 중국, 러시아 및 각국의 여성들이 국내 성매매산업의 한 축을 이루고 있으며, 스마트폰 어플을 통한 미성년자 성매매와 생활고를 이기지 못한 노인여성의 성매매까지 각종 성매매들이 더욱 기승을 부리고 있다.이러한 점에 착안하여, 이 글에서는 성매매산업의 현황과 구체적인 연구의 필요성에 대하여 1차적으로 언급하고자 한다. 그리고 이와 관련된 선행연구를 최대한 충실하게 반영하 되, 단순히 거기에서 머무는 것이 아니라 각종 기사 및 관련산업종사자들과의 (과거)면담 사례와 각종 신문기사 및 기타 자료들을 참고하고자 한다. 그리고 더 나아가 선행연구들의 문제점을 파악하고, 왜 이러한 문제점들이 나타나게 된것인지를 나름 기술해 보고자 한다. 또한 현실의 문제점들을 극복할 수 있는 대안이 무엇 인지에 대해서도 나름의 결론을 도출해 보고자 한다.

영문 초록

On September 23, 2004, the Special Act on the Prevention of Sex Prostitution was enacted. There have been steady efforts by various levels of society to enforce the Special Act on the Prevention of Prostitution. Nonetheless, the most important event in the implementation of the Special Act on the Prevention of Sex Trafficking, which had not been so progressed, fire accident of gunsan. In September 2000, five women died because of a fire in the Street in Daemyeong-dong, Gunsan. These women were deprived of their freedom of residence and suffered from severe prostitution and were unable to escape out of their locks when the fire occurred. As this reality became known to society, the awareness of the need for measures to improve reality spread. On September 23, 2004, the Special Act on the Prevention of Sex Prostitution was enacted. Many anticipated that the implementation of this law would shrink the prostitution industry by not eradicating the prostitution industry. However, more than 10 years after the enactment of the Act, in 2016, the prostitution industry in Korea became a society in which prostitution became more active, unlike the expectation of the law. The new prostitution industry is being reported through the media and women in Southeast Asia, Eastern Europe, China, Russia and other countries are forming an axis of the prostitution industry in Korea, and prostitution of the elderly woman who can not overcome the prostitution of minors through the smartphone application, Are even more proud of them. With this in mind, this article will primarily address the current state of the prostitution industry and the need for specific research. I would like to refer to the past interviews with various articles and related industry workers, various newspaper articles, and other materials as much as possible faithfully, but do not simply stay there. In addition, I will try to explain the problems of the previous studies and explain why these problems have appeared. I will also draw my own conclusions about what alternatives can overcome the problems of reality.
