국문 초록

18세기 근대 자유주의 사상을 배경으로 그 개념이 확립된 인권은 본질적으로 실정법에 의하여 주어지는 권리가 아니라 인간이라는 이유에서 부여되는 천부적인 권리로 인식되었 다. 당시에는 국가가 개인의 자유를 침해해서는 안된다는 자유권을 중심으로 인권을 인식 했으나 20세기 이후 2차례의 세계 대전, 민주주의 전 세계적 확산, 신자유주의 시장경제가 확대되면서, 인권의 문제는 국가권력에 의한 정치적･시민적 자유의 박탈과 억압에서 경제 적, 사회적, 환경적 불평등 및 차별에 의한 인권침해 등으로 확대 전환되어 가고 있다. 인권의 개념이 이처럼 확대됨에 따라서 이를 실현해야 할 주체도 국가에서 개개인의 삶의 터전인 지역 그리고 도시로 전환되고 있다. 광주광역시는 이러한 사고를 배경으로 전국 지방 자치단체 최초로 인권전담 부서를 설치 지역 사회에 인권이 정착되도록 노력하고 있다. 이연구는 광주 인권도시가 구현되고 시민 인권이 보장되는 공동체를 만들기 위하여 인권부 서가 어떠한 역할을 해야 하며 이를 위하여 어떤 점이 보완되어야 하는지 검토하였다.

영문 초록

Human rights, the concept of which were established in the 18th century based on liberalism are understood as an inherent natural right, not a right acknowledged by the positive law. For this reason, all individuals have the human right, because they are human being. In early phase people recognized human right pivoting on freedom which should not be suppressed by the nation. However, the world wars in two times, expansion of democracy, and extension of the market economy based on neo-liberalism have caused the enlargement of the concept of the human right. Today human right means not only the right to freedom. Furthermore it means economic, social and environmental inequality and human right abuse through the discrimination. While the concept of human right is expanded, the main agent realizing human rights is changed from the nation to the region and city which is living foundation of the people. On the basis of this idea, the metropolitan city, Gwang-Ju, set up the department exclusively for human right at the very first from all over the country. This paper deals with what and how the department for the human right should do to build the community in which human rights are guaranteed and what should be complemented for it to attain human right city.
