｢국민보호와 공공안전을 위한 테러방지법｣의 인권 침해 가능성 고찰 및 개선 방향에 대한 검토

국문 초록

우리나라는 세계 유일의 분단국가로서 전쟁의 위험 속에 놓여있는 국가이다. 또한 다문 화주의의 확산과 국제 정세가 불안정해짐에 따라 테러에 대한 공포가 국민들 사이에 퍼지게 되었다. 여기에 2001년 9･11 테러 발생 이후 전 세계는 테러리즘의 공포에 휩쓸리게 되었고, 우리나라에서도 꾸준히 테러방지에 관한 법안이 발의되었다. 하지만 여태까지 발의된 테러방지법안들은 국가권력기관에게 막강한 권한을 부여하고 국민의 기본권은 상당 부분 침해되는 우려를 없애지 못하였다. 이는 ‘국가안보’와 ‘개인의 기본권’의 충돌로 이해될수 있으며, 둘 사이의 이러한 줄다리기는 10년 넘게 지속되어 오다 2016년 5월 본회의를 통과하게 되었다. 본회의 통과과정에서 발생한 비민주적인 절차는 논외로 하고, 현재 효력이 있는 ｢국민보 호와 공공안녕을 위한 테러방지법｣(이하 테러방지법이라 한다)은 소위 ‘독소조항’으로 불리 는, 기본권 침해가 농후한 내용을 포함하고 있다. 이는 “테러”라는 단어의 정의에서부터 시작하여, 우리나라 헌법이 천명하는 행복추구권, 개인정보 자기결정권, 영장주의 등 국민이 당연히 향유할 권리들을 침해할 소지가 있다. 이에 본 논문에서는, ｢테러방지법｣의 입법취지와 내용을 살펴본 다음, 이 법안이 어떠한 점에서 국민의 기본권을 침해하는지 헌법상 기본권 침해여부를 중심으로 살펴볼 것이다. 또한 상기한 법이 제도적으로 어떠한 문제가 있는지, 즉 테러방지활동으로 인하여 야기되는 인권침해를 방지하기 위하여 규정해놓은 인권보호관제도의 문제점도 살펴볼 것이다. 나아가 이러한 문제점들을 분석한 뒤에는 ｢테러방지법｣을 어떻게 개선할 수 있는지, 그리고 과연 ｢테러방지법｣이 우리나라의 실정에 필요한 최선의 선택인지를 논해볼 것이다. 나아가 필자는 우리나라에 테러방지를 위하여 어떠한 제도가 이미 구비되어 있는지, 그리고 ｢테러방지법｣이 폐기된다고 하여도 국가안보라는 과제를 문제없이 이룰 수 있는지 견해를 제시하였다.

영문 초록

The Republic of Korea is the only divided nation in the world, still exposed to the danger of war. Add to this, after the infamous terror in USA, 2001.9.11., the whole world was engulfed in the fear of terrorism, and as a result the members of the South Korean National Assembly proposed bills concerning anti-terrorism. But those bills could not dispel worries that they would endow the government institutions with powerful authority, and with that the people would face human rights abuse. This can be understood as ‘national security’ versus ‘individual rights’. The tug-of-war that lasted more than 10 years finally came to an end when ｢The Act on Anti-Terrorism for the Protection of Citizens and Public Security｣ passed the plenary session in may 2016. Putting aside the issue concerning undemocratic process during the plenary session, the now effective ｢The Act on Anti-Terrorism for the Protection of Citizens and Public Security｣ contains some ‘poisonous clauses’ that are harmful to individual rights. These clauses suggest the possibility of encroaching on basic human rights, which include the right to pursue happiness, the right to informational self-determination, the warrant requirement, etc. In this paper, we will first look at the purpose and content of ｢The Act on Anti-Terrorism for the Protection of Citizens and Public Security｣, then focus on the points that infringe basic human rights. Also, we will consider whether the Act has institutional flaws, that is the problems concerning Counter-terrorism Human Rights Protection Officer institution. Furthermore, we will see how we can improve the current Act, and consider whether ｢The Act on Anti-Terrorism for the Protection of Citizens and Public Security｣is necessary in our society. And in the paper I have stated my opinion on what other institutions are already in effect to prevent terrorism, and also whether our society can deal with the task of achieving national security without ｢The Act on Anti-Terrorism for the Protection of Citizens and Public Security｣.
