인권의 관점에서 본 광주광역시 조례 현황

국문 초록

광주광역시의 조례를 인권의 관점에서 살펴보면 첫째, 다른 여타 지자 체와는 달리 ｢광주광역시 민주․인권․평화도시 육성 조례｣라고 하는 인권 기본조례를 가지고 있고, 둘째, 최근 소수자인권관련 조례가 비약적으로 증가하고 있으나, 늦은감이 없지 않으며, 셋째, 저소득 주민 복지관련 조례가 상대적으로 미흡하다고 평가할 수 있다. 따라서 이후 인권조례의 제정시에는 첫째, 종래의 인권정책에서 보여주 었던 평등의식의 고양 및 차별의식의 해소를 위한 교육활동의 틀을 벗어나 ‘적극적 개선조치’가 반영되도록 해야 하고, 둘째, 이주자 등을 국적이 아닌 주민으로 대우할 수 있는 다양성이 존중되어야 하고, 셋째 인권관련 조례가 지방자치단체의 특성을 반영하고, 절차에 있어서 민주성을 보장받기 위해서는 시민참여가 보장되도록 해야 한다.

영문 초록

The Gwangju Metropolitan City’s ordinance take several meanings. First of all, it is different from other cities, that Gwangju Metropolitan City possesses the fundamental ordinance of human rights, the name of [the Gwangju Metropolitan City’s ordinance for developing democratic, human rights, peaceful City]. Second, thesesday, ordinance is rapidly increased about human rights for minority, but it is regretable that this phenomenon is late. Third, the ordinance for the low-income bracket group can be evaluated on unsatisfaction relatively. As a result, we need to consider several things for making new ordinance for human rights. First, we should reflect the ‘affirmative action’ as getting out of the education form for solving the discrimination and encouraging the equality in a former policy for human rights. Second, we have to respect variety for treating the emigrants not nationality(foreigner) but residents. Third, it needs to reflect the character of a local government in ordinance, and guarantee the participation of citizens for democracy in procedure.
