로스쿨에서의 공익인권법 교육 활성화 방안

국문 초록

법률가 양성제도가 기존의 사법시험 제도에서 로스쿨 제도로 변경됨으로 인하여 여러 측면에서 커다란 변화가 예상되고 있다. 앞으로 변호사의 양성을 담당하게 될 로스쿨에서는 ‘기본적 인권을 옹호하고 사회정의를 실현’한다고 하는 변호사의 사명에 부합하고, 법의 이념이 실현될 수 있는 교육과정을 운영하여야 할 책임을 진다고 할 것이다. 로스쿨에서 운영하는 공익법 프로그램의 효과에 있어서 미국, 영국 그리고 호주의 사례에서 보듯이 로스쿨 학생에 대해서는 사회에의 환원을 포함한 법률가의 직무적 책임을 이해하도록 하고, 타인을 돕겠다는 동기를 강화하며, 그 동기를 이상과 결합시키도록 하는 등의 교육적 효과가 있고, 로스쿨에 대해서도 지역사회와의 연계, 동문들과의 연계, 로스쿨에 대한 신뢰 증대 등의 긍정적 효과가 있는 것으로 나타나고 있다. 공익변호사그룹 공감에서는 예비인가를 받은 25개 법학전문대학원을 대상으로 공익인권법 프로그램(계획)에 관한 설문조사를 실시하였는바, 교육 목표에 있어서는 과반수의 법학전문대학원이 윤리성을 갖춘, 책임감 있는 법조인 양성을 주요한 목표로 설정하고 있었으나, 이러한 공익지향성이라는 교육 목표에 비해 교과목이나 실습과정 그리고 교원과 프로그램에 있어서 보다 많은 준비가 필요로 한 것으로 나타났다. 로스쿨 예비인가를 받은 학교 측에서는 교육을 실제 담당할 교수진과 함께 공익인권법의 중요성에 대해 깊이 인식하고, 그러한 인식을 바탕으로 하여 교과목 편성과 구체적인 교과목 운영에 있어서 이를 반영하여야 하여야 하고, 교과목 이외의 공익인권법 프로그램도 그와 같은 인식하에 운영되어야 한다. 로스쿨에서 공익인권법 교육이 활성화되기 위해서는 공익법활동 프로그 램에 적어도 한 명의 전담자를 두고, 공익인권법 강의가 가능한 적절한 교원을 확보하고 연구센터를 중심으로 전체적인 교과과정과 프로그램을 운영 하는 것이 필요하다. 또한 법학전문대학원협의회 등이 나서서 공익인권법 교육 프로그램의 체계적 정리, 모델의 개발 등을 수행하여야 하며, 각 대학 실정에 맞게 다양한 공익인권법 프로그램을 지금부터라도 진행시키면서좀 더 적절하고 구체화된 모델들을 현실화시켜 나가야 할 것이다.

영문 초록

As the lawyer training system changed from the judicial board examination system to the law school system, many changes in a variety of aspects are anticipated. Law schools to take care of lawyer training in the future will have to take the responsibilities to correspond with the lawyer’s mission ‘to defend basic human rights and to realize social justice’ and to operate education programs to realize the principles of law. As for the effects of pro bono and public interest programs provided in law schools which have been demonstrated in U.S.A, England, and Australia, the programs turned out to have some educational effects on law school students to help them understand the vocational responsibility including social restoration as a lawyer and to strengthen their motive to help others and to combine their ideals with reality. It has been also demonstrated that such programs have some positive effects on law school per se such as connection to local community as well as alumni and trust building in law school. Korean Public Interest Lawyer’s Group ‘Gong-Gam’ surveyed 25 law schools authorized preliminarily regarding pro bono and public interest programs (plans). The results showed that although more than half of the law schools set training of lawyer to have ethics and responsibility as the major educational goal, more preparation was required in the curriculum, practicum, teaching staffs, and program compared to the educational goal oriented toward pro bono and public interest. The law schools preliminarily authorized together with the teaching staffs should be deeply aware of the importance of pro bono and public interest, and based on this awareness, they should organize the curriculum and reflect this in specific classes, and also operate pro bono and public interest programs besides the curriculum under such awareness. In order for the education of pro bono and public interest to be revitalized in law schools, they have to assign at least a fullyresponsible staff to the pro bono and public interest program and secure proper teaching staffs who are able to instruct pro bono and public interest and operated overall curriculum and programs centered around a research center. In addition, institutions such as Law School Council initiate systematic organizing work of educational programs, model development, and so on. In addition, they also have to begin the pro bonoand public interest programs appropriate for each school from now on and translate the more proper and specified models into reality.
