미국대학에서의 인권교육프로그램 조사 및 분석

국문 초록

대학에서의 미래 인권변호사들을 위한 인권교육은 필수적인 요소라 할것이다. 지금 우리는 미래의 인권변호사 양성을 위한 대학 인권교육의 활성화가 시급하다고 할 것이다. 그럼에도 불구하고 우리나라의 대학에서의 인권교육은 아직까지는 초보적인 수준에 머무르고 있다. 대학에서의 미래 인권변호사들을 위한 인권교육은 필수적인 요소라 할것이다. 지금 우리는 미래의 인권변호사 양성을 위한 대학 인권교육의 활성화가 시급하다고 할 것이다. 그럼에도 불구하고 우리나라의 대학에서의 인권교육은 아직까지는 초보적인 수준에 머무르고 있다. 본 소고에서는 2009년에 시행될 로스쿨에서의 교과과정 혹은 대학수준 에서의 인권전문가 양성에 조금이나마 도움이 되었으면 하는 바람으로 미국 대학 인권교육 시스템에 대한 조사와 분석을 시행하였다. 그 첫 번째 사례로서 하버드 로스쿨의 인권프로그램(Human Rights Programme, HRP)은 국제적 인권활동을 확대하고 인권교육의 중요성을 강조 하기 위해 추진되고 있는 프로그램이다. 헨리 슈타이너 교수에 의해 발족된 이 프로그램은 올해로 24년째를 맞이하고 있다. 여름봉사활동, 클리닉 운영, 인권발표회, 인권연구, 장학금지급 등을 통하여 인권활동과 연구에 학생의 참여를 주요활동으로 하고 있다. 또한 국내․외의 인권기관 및 하버드인권저널, Harvard Law Student Advocates for Human Rights와 같은 학생기구들과 협력관계를 계속적으로 확대하면서 인권관련 국제학술회의나 세미나를 개최하고, 인권관련보고서의 출간 및 인권관련 프로그램의 운영을 통해 인권교육장학금을 지급하고 있었다. 이 프로그램의 구성원들은 학생들로 하여금 인권기관과 함께 연구․조 사활동을 추진하게 하고, 인권분야에 대한 추천을 하고 있으며, 이러한 활동들을 통해 국제인권분야를 하버드 로스쿨 법률교육의 한 분야로 발전시 키고 있다. 또한 장학금의 지급, 고용창출, 논평 및 제안 등의 방법으로 미래의 인권운동의 지도자가 될 학생들을 교육하는데 노력하고 있음을 알수 있었다. 그 두 번째 사례로서 컬럼비아 대학교는 직업교육과 학부․대학원 등의 대학교육에 인권을 대두시킨 최초의 대학이다. 또한 컬럼비아 로스쿨은 최초의 인턴쉽 프로그램과 인권실습 과목을 포함하여, 미국 또는 전 세계 법학 교육에서 제일 먼저 포괄적인 인권 프로그램을 보유하게 된 학교이기도 하다. 현재 컬럼비아 대학교는 매년 약 75명의 학생들을 미국을 포함한 전세계 인권NGO나 정부기관에 인턴쉽으로 보내고 있으며, 그 수는 지난 20년 동안 약 2,000명에 이르고 있으며, 특히 컬럼비아 대학의 로스쿨은 수십년 동안 인권교육에 기초하여 1988년도에 차세대 변호사, 교사, 인권 전문 가를 양성하기 위한 인권연구소(Human Rights Institute)를 설립하여 인권 이론과 실제, 법과 다른 학문영역, 국내(헌법상)의 인권과 국제 인권 사이의 가교 역할을 담당시키고 있었다. 컬럼비아 대학교의 인권연구소는 심포지엄, 학회, 강의 등의 프로그램과 교수․학생의 교환, 인권장학금 지급과 인턴쉽 프로그램을 통해 학생들을 국제적인 인권활동에 참여시켜 그 역량을 발휘하도록 하고 있다. 마지막으로 미네소타 대학의 인권교육은 대학 내의 활동에 국한되지 않고, 미네소타 인권센터를 중심으로 학생, 교사, 변호사, 지역사회 리더 등, 지역과 나라와 세계의 인권조직과 함께 실제 경험을 쌓을 수 것부터 다양한 정보의 교류와 제공을 함께 하는데 그 의의를 두고 있었다. 미네소타대학 인권센터는 국제인권선언 40주년인 1988년 12월에 설립 되었으며, 가장 중점을 두는 일은 인권전문가와 자원활동가에 대한 효과적인 훈련지원이다. 인권센터는 인권변호사와 모니터요원, 학생, 교육가 등을지원하기 위해 다음의 다섯 가지 기본 프로그램을 운영하고 있다: 첫째, 인권보호 활동에 필요한 연구 및 조사는 인권변호사와 활동가들을 도와 작업의 효율성 개선을 지원하는 것을 말한다. 둘째, 교육자료의 개발은 유엔의 인권감시와 훈련 지침서, 인권교육시리즈, 인권 패스포트를 개발하는 것을 가리킨다. 셋째, 현장연수기회로는 어퍼 미드웨스트, 인권 펠로쉽 프로그램, 센터의 인턴쉽과 펠로쉽, 대학 강좌, 자원봉사자 연수, 연례 개최되는 미국인권교육연수, 기타 연합 프로그램 등이 있다. 넷째, 인권온라인은 미네소타 대학교 인권도서관과 자료센터 그리고 온라인 카탈로 그를 가리킨다. 다섯째, 학습 커뮤니티와 협력단체들은 지역, 국가, 국제사 회의 20여개 비영리조직에 프리젠테이션, 워크숍, 100가지 이상의 인권교 육자료를 배포하는 것을 말한다. 이러한 대학 및 법학전문대학원에서의 인권교육 프로그램의 개발 필요 성에 근거해 미국의 대학과 법학전문대학원에서 실시하고 있는 인권교육프 로그램을 분석

영문 초록

High quality university education is essential for providing the skills and intellectual framework of the human rights defenders of tomorrow. And Now, We have to contribute way to training future human rights advocates. Nevertheless, korea has not been preparing the system for human rights education even in university level. I tried to find proper models for promoting korea human rights education in university level or law school curriculum going to begin at 2009. The first case which I found was the Human Rights Program at Harvard Law School. The Human Rights Program (HRP) at Harvard Law School seeks to give impetus and direction to international human rights work at Harvard Law School. Founded by Professor Henry Steiner and now in its twenty-fourth year, the HRP fosters coursework and student participation in human rights activities through its summer fellowships, clinical work, speaker series, applied research, and scholarship. The HRP forges cooperative links with human rights organizations in this country and abroad, and works with student organizations such as the Harvard Human Rights Journal and the Harvard Law Student Advocates for Human Rights. The HRP plans and directs international conferences and roundtables on human rights issues, and publishes reports and scholarship resulting from these events. Its staff advises students wishing to conduct research projects with human rights organizations, and provides counseling on careers in the field. Through these activities, the HRP seeks to make international human rights an integral part of a Harvard Law School education. It works to educate students who will be among the leaders of the human rights movement, and foster progress within the movement through its scholarship, engagement, criticism and suggestions. The second case was the Columbia University. Columbia University was the first to make human rights prominent in university education - professional, graduate, and undergraduate. Columbia Law School has the oldest comprehensive human rights program in legal education in the United States, perhaps in the world, including one of the first internship programs and human rights clinics. In 1998, building on decades of human rights education, Columbia Law School founded the Human Rights Institute to help train the next generation of lawyers, teachers, and human rights professionals. The Institute is dedicated to building bridges between theory and practice; between law and other disciplines; between national (constitutional) rights and international human rights. Through programs of symposia, conferences, and lectures, and through faculty and student exchanges, fellowships and internships, the Institute renders Columbia’s participation and influence worldwide. The third case was the Minnesota University. Especially, The Human Rights Center in Minnesota University assists human rights advocates, monitors, students, educators, and volunteers access effective tools, practices, and networks to promote a culture of human rights and responsibilities in our local, national, and international communities. The University of Minnesota Human Rights Center was inaugurated December 1988 on the occasion of the fortieth anniversary of the Universal Declaration of Human Rights. The principal focus of the Human Rights Center is to help train effective human rights professionals and volunteers. The Human Rights Center assists human rights advocates, monitors, students, and educators through five primary programs: Applied Human Rights Research to assist human rights advocates and activists in improving the effectiveness of their work; Educational Tools through the development of UN human rights monitoring and training manuals, the Human Rights Education Series, and human rights passports; Field and Training Opportunities through the Upper Midwest Human Rights Fellowship Program, Center internships and fellowships, university courses, volunteer trainings, annua
