어퍼머티브 액션에 관한 일 고찰

국문 초록

1961년 케네디 대통령이 도입한 어퍼머티브 액션은 인종, 성별, 종교, 장애 등의 이유로 불리한 처지에 있는 사회적 소수자들에게 우대조치를 제공함으로써 차별과 불이익을 시정하려는 정책이었다. 본 논문은 우선 어퍼머티브 액션이 실시된 역사, 시대적인 배경, 입법 취지와 목적, 실행과정을 살펴보았다. 이어 이 정책의 찬성론자와 반대론자의 주장들이 각기 어떤 논리적 근거와 한계를 지니고 있는지, 특히 어퍼머티브 액션의 정책적 타당성과 실효성에 대한 찬반 논쟁에 초점을 맞추어 고찰하였다. 이울러 본 연구는 미국 공공정책의 역사에서 50년이라는 장기간에 걸쳐 시행되고 있는 어퍼머티브 액션에 대한 평가와 함께, 앞으로도 지속적으로 추진할 명분과 가치가 있는 지에 대하여 살펴보았다.

영문 초록

Affirmative action is one of the most controversial and divisive issues in America. There is great debate regarding the effectiveness of the policy. In order to understand the rationale behind affirmative action, this paper discusses what affirmative action really is, how it has been formulated, and why it has created such a controversy. With these things in mind, this paper consider the ideological strengths and weaknesses of affirmative action policies, their effectiveness, and possible alternatives to them. This paper especially tries to evaluate the weak and irrational cases against affirmative action which are heavily based on myth and misunderstanding. As a nation that prides itself on the American Dream as well as freedom and equality, Americans all hope that it is possible for anyone to make it if they work hard enough. However, racial and gender discrimination and biases are still entrenched in American society and institutions. Thus affirmative action still remains an effective weapon in the fight for racial and gender equality in America.
