로크의 자유론

국문 초록

최근 정치사상사 학계와 정치철학계의 일반적 합의에 의하면 자유주의의 핵심적 원리는 그 독특한 소극적 자유론이라고 할 수 있다. 즉 자유주의는 자유를 국가나 타인의 외부적 방해와 간섭의 부재에 한정시킴으로써 개인의 사적 영역을 불가침의 영역으로 성역화 한다. 현대 자유주의자들은 로크를 개인주의적 권리 담론의 태두로 자리매김해왔다. 그 누구도 침해받을 수 없는 권리의 담지자로서 개인을 설정하고 근대 이후 등장한 국가 권력으로부터 그러한 개인을 보호할 수 있는 철학을 로크가 제공했다는 것이다. 그렇다면 그의 자유론은 철저히 소극적 자유론이어야한다. 즉 외부의 간섭의 부재가 곧 나의 자유가 될 때 그러한 논변은 유지될 수 있다. 이성이라는 명목 하에, 공동선이라는 미명하에, 내가 하고 싶은 것을 못하게 하는 것은 그 목적이 아무리 숭고한 것이라고 하더라도 나의 자유를 빼앗는 것이다. 그러나 로크의 자유론은 이러한 소극적 자유론이고 할 수 없다. 그는 진정한 자유는 이성적인 지성에 의해 지배되는 삶을 사는 것이요 정치적 자유도 공동선을 실현해야 하는 의무와 별개로 논의될 수 없다고 보았다. 즉 자유는 도덕적 진공상태에서 무엇이던 방해 받지 않고 할 수 있는 것이 아니라는 것이다. 이렇게 볼 때 로크를 전적으로 자유주의와 연관시키는 것은 적절하지 않다고 볼 수 있다. 오히려 그의 자유론을 오늘날 회자되고 있는 공화주의 자유론과 연관시켜 논의하는 것이 그 지성사적 위치를 가늠해 보는데 더 유용하다.

영문 초록

John Locke is respected as an intellectual saint amongst contemporary liberals in any kinds who provided philosophical bases of modern liberalism. They think of liberalism as the very political ideology proper in the modern world which aims at protecting individual rights and private sphere against modern sovereign state. And they agree that in the core of liberalism is negative liberty as non-interference. This paper investigates if this thesis is accountable by discussing Locke’s concept of liberty in the context of seventeenth century political discourse in England and by interpreting it with reference to contemporary republican view of liberty as non-domination. Chapter II reviews seventeenth century English republican view of liberty in the classical version of freeman versus slave which criticized vehemently Hobbesian negative liberty which denied classical free state thesis of liberty. Chapter III finds that Lockean liberty is not negative one as liberals believe. Rather it is positive one which emphasizes that liberty should not be enjoyed in moral vacuum. Therefore Locke believed firmly with republicans against Hobbes that rationally enforced law by consent of people does not diminish liberty but enlarge it. Chapter IV tells contemporary republican interpretations of Lockean liberty. Pettit estimates it as a republican non-domination liberty which insists that the very presence of arbitrary power is inimical to liberty though it does not interfere actually. On the contrary, Skinner excludes Locke from republican camp because he permitted royal prerogatives for realization of common good which seventeenth century republicans regarded as symbol of slavery in which people had to live by depending on the mercy of ruler. Chapter V concludes that Lockean liberty is not at least liberal one which guarantees individuals to leave alone to do what they list without citizenship and rational moral judgement for public interests and common good.
