이 논문의 주요내용을 간략히 정리하자면 다음과 같다. 이 논문은 2014년 1월 여수에서 발생한 대규모 오염사고에 대한 형사재판(제1심 판결, 2014 고단 584, 689(병합), 제2심 판결 2014노3277)의 주요 쟁점을 검토한 것이다. 첫 번째 이슈는 공동과실로 인한 해양오염사고에 대한 처벌의 적절성에 대한 판단이다. 학설에 따르면 과실에 의한 공동정범을 부정하기도 하지만, 재난적 상황에 대한 처벌의 필요성 때문에 판례는 일관하여 공동과실을 인정하고 있다. 이번 판결에서도 선박충돌과 저유시설 관리소홀에 대한 공동과실을 단체로 인정하였는데, 이에 대해 적절성 등을 검토하였다. 두 번째 이슈는 재난적 해양오염사고 에 대한 원인행위자의 조사방해 행위 등에 대해 위계에 의한 공무집행방해죄를 적용한 것의 적절성 여부이다. 형법과 재난학의 공통된 관심사인 공공의 안전이라는 측면에서 적절성 여부를 판단하였다.

영문 초록

To be simplified to organize the main points of this paper is as follows. This paper is to review the legal issues concerning criminal case of the catastrophic marine pollution incident which was occurred at Yeosu in January, 2014. First item is to review the application of common negligence regarding multi- related-polluters which took part in pollution incident. According to the theories regarding the issue, it is standing at the negative position, however, judicial precedent shows they stand positive stance by many similar cases. In this case, judgement also applied the joint negligence of oil spill by four dependants by them together. Another issue is passibility of application of obstruction of investigation to the polluting facility at initial stage in order to establish the pollution countermeasure such as checking the kind of pollutant and spillage quantity. This review is considered by the both aspects of criminal law and disaster science for public safety and security.
