국문 초록

个人信息不同于隐私等人格利益，其所对应的个人信息权是数字化的人格权利以及对个人信息相关性的控制。个人信息权不仅具有人格利益，也具有财产利益。个人信息权财产利益的应然性并不源于信息的流通价值，而在于有意图提供相关个人信息所具有的“对价性”。为实现个人信息主体权利的有效保护，立法需充分考虑大数据环境下个人信息主体与信息收集者之间的实力差距，重塑“公正”之意，从个人信息主体的知情权与个人信息流转权两个维度，把握个人信息权利内容的科学建构。

영문 초록

Personal identifiable information (PII) is different from personality, and its right contains the right to live in the internet and the control of personal information. The right of PII contains personality and property interests. The rationality of PII with property characteristic is from its contractual nature when the owner of PII offers relevant PII according to some requirement, rather than from its value of transmit. In order to effectively and fully protect the right of the owner of PII, the legislation should take the gap between the owner and the user or the collector of PII into consideration to reshape the value of fairness, and should set up the content of PII right from two dimensions, including the right to know and to transmit PII.
