경찰의 디지털포렌식 현장지원 조직의 필요성과 운영방안

국문 초록

디지털포렌식 현장지원 조직은 디지털증거 압수･수색시 현장을 지원해 주는 디지털포렌식 전문조직을 말한다. 현재는 이와 같은 업무를 디지털증거 분석관이 담당하고 있으나, 현재 분석관 인력만으로는 지방경찰청에 분석의뢰된 디지털 증거물 수요도 감당하기 힘든 상황이다. 본 논문에서는 경찰의 디지털증거 압수･수색시 현장지원 실태를 파악하여, 디지털포렌식 현장지원 조직 신설의 필요성과 운영방안을 제시하였다. 실태조사 결과 디지털포렌식 현장지원 요청건수가 현장수요에 비해 매우 저조한 것으로 조사되었다. 이와 같은 결과는 디지털포렌식 현장지원 조직의 부존재, 디지털증거 분석관의 과중한 업무와 즉시성 부족, 압수현장에서 선별적 압수의 원칙 미 실현 등이 이유인 것으로 분석된다. 형사소송법 제106조 제3항의 실현, 피압수자의 인권 및 권리보장, 수사의 효율성 확보를 위해서는 디지털포렌식 현장지원 조직이 필요하다. 각 지방경찰청내에 포렌식현장지원계를 설치하여 분산형 권역지원체제 방식으로 조직을 운영하는 것이 효과적이다. 디지털포렌식 현장지원 조직이 신설될 경우 담당해야할 업무는 다음 7가지이다. 압수･수색 영장신청 지원, 증거획득 및 현장선별, 복제본(이미징)생성, 자동분석, 분석의뢰서 작성지원, 증거물 관리, 포렌식 교육 등을 현장지원 조직이 담당할 업무이다. 디지털포렌식 현장지원 조직은 수사의 효율성에서뿐만 아니라, 피압수자의 인권보장 차원에서도 매우 중요한 역할을 한다. 디지털포렌식 현장지원 조직이 신설되어 디지털증거 압수･수색을 지원한다면 현재의 아날로그 수사체계를 디지털 수사체계로 한 단계 업그레이드 할 수 있는 기반을 마련할 수 있을 것이다.

영문 초록

A digital forensic on-site support organization is a digital forensic professional organization that assists the site in the seizure of digital evidence. Currently, digital evidence analysts are in charge of such tasks, but currently analysts alone are unable to meet the demand for digital evidence from analysts. In this paper, the necessity of the establishment of the digital forensic field support organization and the operation plan are suggested by grasping the field support situation when the police seize digital evidence. As a result of the survey, it was found that the number of requests for digital forensic field support was very low compared to the demand in the field. These results are due to the absence of the digital forensic site support organization, the heavy work of the digital evidence analyst, the lack of immediacy, and the fact that the principle of selective seizure at the seizure site is not realized. In order to realize the realization of Article 106 (3) of the Criminal Procedure Law, guaranteeing the human rights and rights of the people to be seized, and securing efficiency of investigation, digital forensic field support organization is needed. It is effective to establish a forensic field support system in each local police office and operate the organization in a distributed regional support system. When a digital forensic site support organization is newly established, the following seven tasks are required. The field support organization is responsible for support for seizure and search warrants, obtaining evidence and screening, creating replicas, automatic analysis, supporting the preparation of analysis request books, managing evidence, and forensic education.
