국문 초록

우리나라의 산업은 짧은 시간동안 크게 발전해 오고 있다. 이러한 성장의 뒷면에는 부작용이 따르고 있는데, 바로 산업재해이다. 산업재해와 관련하여 1981년 산업안전보건법이 제정되었는데, 이 법률은 우리나라의 산업현장을 반영하듯 점차 그 처벌이 강화되어 왔다. 그리고 최근에 들어 산업안전보건법은 전부개정을 통해 형벌의 강화뿐만 아니라, 그 책임주체에 대해서도 확대를 시도하고 있다. 이를 둘러싸고 지나치게 사업주에게 책임을 묻는 입법이 아니냐는 지적이 있다. 하지만 빠르게 변화하는 산업현장을 고려할 때 산업재해를 예방하기 위한 방안은 더 이상 미뤄서는 안될 일이다. 물론 법률을 강화하는 것이 예방을 위한 최선의 선택은 아니다. 그리고 벌칙규정을 강화하는 것이 사고예방의 필연적 관계에 있는 것도 아니다. 그런데 그동안 처벌규정을 강화해 왔음에도 불구하고 산업재해에 대한 우려의 목소리가 나오는 이유는 무엇인가. 그것은 실제로 산업현장에 대한 사업주의 책임추궁에 대해 미비한 처벌이 문제였으며, 사업주가 책임회피를 할 수 있었던 법의 흠결에서 찾을 수 있다. 이러한 문제에 대해 이번 산업안전보건법의 개정은 그동안의 법의 흠결을 메우려고 하는 시도로 평가할 수 있다.

영문 초록

South Korean industry has developed rapidly over recent years, but this growth has lead to various side effects including industrial disaster. As a preventative measure, The Occupational Safety and Health Act was established in 1981, and penalties have gradually been strengthened in South Korea. Recent revisions of The Occupational Safety and Health Act not only further strengthened punishment, but also attempted to expand the scope of responsibility through revision to the law. Complaints have been raised that legislation now holds employers excessively accountable for industrial accidents. However, considering the rapidly changing industrial settings, we can no longer delay in further developing plans for industrial accident prevention. Despite strengthening regulations and penalties there have been no significant decreases in the levels of industrial accidents, and concerns are still being raised in spite of the changes to the law. This is because punishment of irresponsibility employers is still inadequate in industrial settings, as well as flaws in the law which allow employers to avoid responsibility. It still remains to be seen if revision of The Occupational Safety and Health Act will be able to cover these gaps in the law, and what supplements will be needed from now on.
