국문 초록

사법기관이 범죄사실 확인을 위해 압수·수색을 할 때, 개인의 기본권 보호 기대 수준과 사안의 경중에 따라 ‘압수․수색 대상’의 범위와 ‘압수 목적물’의 제한 요건을 비례적으로 판단하여 그 적절성을 검토하여야 한다. 이러한 비례의 원칙은 디지털 증거를 대상으로 하는 압수·수색에서도 예외가 될 수 없음에도 불구하고 사법기관의 압수·수색 실무에서 그 대상물은 ‘정보저장매체’로, 그 결과물은 ‘선별된 파일’로 획일화된 접근을 하고 있다. 극도로 다형화된 디지털 증거에 대하여 일괄된 기준에 따라 접근하는 것은 국가의 범죄 대응능력을 저하시키고 개인의 기본권을 과도하게 침해하는 비합리적인 결과로 이어질 수 있다. 따라서 사법기관에서 사안의 성격에 따라 직관적으로 비례의 원칙을 고려하여 판단할 수 있도록, 디지털 자료 저장 방식과 시스템 구성에 따른 객관적인 기준으로 디지털증거를 다섯 계층으로 나누고 접근하는 방안을 제시하였다. 또한, 디지털 증거를 취급하는 실무환경에서 기존 처리 절차의 변경 없이 보다 효과적인 증거처리가 가능한 사실을 확인하였다.

영문 초록

When the law enforcement agencies search and seize evidence to find the fact of crime, the object and scope of search and seizure should be considered according to seriousness of the case and the protection of fundamental rights, and judged by the principle of proportionality. Although law enforcement agencies should follow the principle, they have taken a uniform approach, which regards an information storage medium and the selected files as object and results of search and seizure, respectively, in search and seizure of digital evidence. It leads to deterioration of the national response capacity of the criminal and excessive infringement of the fundamental rights, resulting in a variety of problems. This paper presents our approach of dividing digital evidence hierarchically by using objective criterion. In order to achieve this goal, the concepts of ‘Design of the System Kernel’, ‘Layout of the Filesystem’, and ‘Legal Perspective of the Electronically Stored Information as Evidence’ are considered. Divided digital evidence consists of five layers: Physical, Container, Named, Data, Rendering layer. This hierarchical approach for digital evidence can address issue by applying the principle of proportionality related to digital forensics. Furthermore, the conformance in the present environments is also considered by applying the hierarchical approach for digital evidence to the ‘Digital Forensics Process Model’. In conclusion, the ‘Digital Evidence Hierarchy Layer’ might help the law enforcement agencies balance between protection and limitation of the fundamental rights without any change in legacy process.
