일본 국내법상의 유엔 해양법협약 이행에 관한 고찰

국문 초록

이 글에서는 1982년에 체결된 해양법협약이 일본에서 어떻게 이행되고 있는지를 알기 위하여 해양법과 관련된 일본의 국내법들로서 영해와 접속수역에 관한 법률, 영해 등에서의 외국선박의 항행에 관한 법률, 배타적 경제수역 및 대륙붕에 관한 법률, 배타적 경제수역 및 대륙붕의 보전 및 이용의 촉진을 위한 저조선의 보전과 거점시설의 정비 등에 관한 법률, 배타적 경제수역에서의 어업 등에 관한 주권적 권리의 행사 등에 관한 법률, 해양생물자원의 보존 및 관리에 관한 법률, 해양오염 등 및 해상재해의 방지에 관한 법률, 해양구조물 등에 관련되는 안전수역의 설정 등에 관한 법률 등과그 시행령의 내용을 살펴보았다. 일본은 1982년 해양법협약과 조화되도록 국내법제를 정비하고 있으나 배타적 경제수역이나 대륙붕에 관하여 과도한 관할권을 주장하는 것이나 이들에 관하여 중간선을 일방적으로 해양경계로 정하고 있는 것 등은 해양법협 약과 일치되지 않는 것으로 보인다.

영문 초록

The reality of implementation of a treaty in a monist State like Japan may be grasped only through reviewing relevant domestic laws of the State. This is the reason why we must examine Japanese domestic laws regulating maritime affairs to understand how the 1982 UNCLOS is implemented in Japan. For this purpose this article first reviews the marine policy of the Japanese government during the time of the Third United Nations Conference on the Law of the Sea, and proceeds to examine domestic laws of Japan related to subjects of the UNCLOS such as Act on the Territorial Sea and the Contiguous Zone, Act on the Exclusive Economic Zone and the Continental Shelf, Act on the Exercise of the Sovereign Right for Fishery, etc. in the Exclusive Economic Zone, Act on Preservation and Control of Living Marine Resources, Act on the Prevention of Marine Pollution and Marine Disaster, Act on Passages of Foreign Ships in the Territorial Sea etc., and Act on the Establishment of Safety Zone Around Marine Structures, etc. The result of the review and examination tells us that Japan organized and rearranged domestic institutions and law to be harmonized with the UNCLOS. Nevertheless, some domestic law of Japan seems to be not in accordance with the UNCLOS. The excessive establishment of straight baseline, immoderate argument of the EEZ and the continental shelf based on unacceptable interpretation of the Art. 121, para. 3 are salient examples.
