국문 초록

1958년 제네바협약 체제에 비판적이었던 중국은 1973년부터 제3차 UN해양법 회의 전체 일정에 참여 자국의 이익을 적극 반영하며, 국제적 논의결과는 국내법으로 수용하 였다. 중국은 군함의 영해내 무해통항권, 해양경계획정 및 심해저 제도, 유보제도에 대한 불만에도 불구하고 유엔해양법협약을 비준하였으며, 협약이 연안국에게 부여하는 권리의 가장 큰 수혜자이기도 하다. 전체적으로 중국은 유엔해양법협약과 1970년대 이후 국제협약 형성 참여를 통해, 해양관련 법제도를 전반적으로 체계화 하였는데, 이에 대하여는 긍정적 측면과 함께 해양에 대한 종합적 조정력과 법구조적 한계에 대하여는 여전히 비판적 견해가 병존한다.

영문 초록

China which was critical to Geneva Convention system in 1958 participated in whole schedule for the 3rd UN Conference for the Law of the Sea from 1973 and actively reflected its own interest while accommodating the result of international discussion in domestic laws. In spite of complaints on harmless navigation right of warships within territorial waters, delimitation of maritime boundaries, deep seabed system and saving clause for the Convention, China ratified UNCLOS, and after all China became the biggest beneficiary for the rights granted to coastal states by the Convention. China systemized overall maritime related law system through the participation in forming UNCLOS and International Conventions since 1970 s, and for this, critical viewpoint is still existing for the general adjustment power and the limit of law structure for maritime together with positive aspect.
