도시정비법상의 조합설립추진위원회의 유용성에 관한 고찰

국문 초록

1976년 도시재개발법에 의하여 도심재개발사업에 토지등 소유자들로 구성된 조합이 참여함으로써, 도시의 기능회복과 주거환경의 개선에 일조하였다. 그러나 주택을 정주수단이 아닌 재산증식 수단으로 인식됨으로써 조합설립과정에 많은 부조리가 나타나게 되었다. 그 동안 법적 테두리를 벗어나 있던 조합설립추진위원회를 2003년 도시정비법의 규율대상으로 함으로써 적법성을 확보하였다. 그러나 최근에 이르러 조합설립추진위원회를 설립하기 위한 준비위원회가 또 다시 탈법의 근거가 되고 있기에 오히려 조합설립추진위원회제도 자체의 존재를 원점에서 다시 고민해 볼 필요가 나타났다. 정비사업별 추진위원회의 구성여부, 추진위원회의 구성시기 및 조직･업무･운영을 살펴보면, 추진위원회는 한시적이고 임시적인 기관에 불과하다. 그럼에도 불구하고, 조합설립추진위원회를 구성하기 위한 (가칭)추진위원회가 중복 조직되고 난립･갈등의 양상을 보이고 있으므로, 추진위원회제도 자체를 폐지하고 추진위원회의 기능을 주민대표회의에 부여하거나 공공관리제도를 활용하는 방안을 고려해 볼 시기가 되었다.

영문 초록

Under the Urban Redevelopment Act in 1976, the the committee of promoters to establishment an association(hereinafter referred to as committee of promoters ) which was made up of landowners participated in the urban rearrangement project and the committee of promoters contributed to the restoration of the functions of the city and the improvement of the residential environment of the residents. However, it is recognized that housing is not a means of settlement but a means of property increase. We secured the legitimacy of the committee of promoters, which was outside the legal framework, by subjecting it to the discipline of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents of 2003. However, since the preparation committee for establishing the committee of promoters recently becomes the hotbed of illegality, it is necessary to re-examine the existence of the committee promoters system itself from the origin again. The committee of promoters is only a temporary and time-limited institution, considering whether the committee is organized by the rearranement projects, when the committee of promoters is organized, and the organization, business and operation of the committee of promoters. Nevertheless, since the preparation committee (tentative name) for establishing the committee of promoters is duplicated, it shows the pattern of conflict, so it is time to consider about the abolishing the committee of promoters system itself, Giving the functions of the committee of promoters to the resident representatives meeting and how to use the Pubic Management system.
