국문 초록

서양학계에서는 흔히 법과 감정은 서로 대립되는 것으로 받아들여져 왔다. 법과 감정의 경계선은 명확히 그어 졌고, 그 둘은 서로 양립할 수 없는 것으로 간주되었던 것이다. 그러나 최근 연구에서는 이러한 시각에 의문점이 제기되기 시작하였다. 감정 연구에서 “인식론적 전향”이라는 접근방법이 널리 받아들여지면서 법에서의 감정역할이 인정받게 된 것이다. 특히 조선시대 법과 사례들을 살펴볼 때 법과 감정의 상관관계가 뚜렷이 나타난다. 유교윤 리의 두 기둥인 효(filial piety)와 열 (fidelity)은 재판판결을 내는데 있어서 특히 중요한 역할을 하였다. 이 글에서는 15세기 정씨 부인과 사위 강씨 와의 재산분쟁을 통해 인정(人情)이란 것이 효와 열과는 어떤 연관성이 있으 며, 그리고 분쟁의 판결을 도달해 내는데 있어서 인정이란 감정의 문제가 어떻게 개입되고 중요하게 다루어졌는지를 살펴보았다. 관료들의 담론을 통해 효와 열이라는 덕목이 공적인 장에서 어떻게 경합하는지를 밝히고, 나아가 부부 간의 의리와 부모 자식 간의 질서중 “효”를 우위에 두고 판결이 내려졌 음을 알 수 있다. 이것은 조선초기 부 모와 자식 간의 위계 질서가 젠더 간의 위계질서보다 우위에 있다라는 것을 보여준다.

영문 초록

Emotions have been commonly accepted as antithetical to law in Western scholarship. The conventional wisdom on law and emotions has clearly demarcated the line between the two and treated them as mutually exclusive entities. However, recent scholarship has challenged this separation and recognized the role of emotions in law with the rise of the “cognitive turn” in the study of emotions. In the context of Chosŏn Korea (1392~1910), when examining the legal practice, it is evident that law and emotions are mutually constitutive. The two pillars of Confucian ethics, filial piety and fidelity, often played an important role in determining the outcome of cases. By closely examining a property case that occurred between Madam Chŏng and her son-in-law in the mid-fifteenth century, I show how humane feelings, or inchŏng 人情, related to filial piety and fidelity were crucial factors in judging the case. Through the investigation of discourse that took place among high-ranking bureaucrats at the central court, the paper demonstrates how Confucian familial relationships, such as those between a parent and a child and between a husband and a wife, were not fixed but were flexibly construed familial bonds and how the kernel of the case was to determine whether the humane emotions related to filial piety preceded fidelity.
