법조전문자격사의 변리사 중심의 동업의 필요성에 관한 소고

국문 초록

법률시장 개방과 4차 산업혁명 시대의 지식재산과 특허권의 보호가 사회적 쟁점 사안으로 부각되고 있다. 그동안 우리나라에서는 법률시장 개방으로 법률서비스 경쟁력 강화와 로스쿨 도입으로 변호사가 대량으로 공급됨에 따라 변호사 중심의 비변호사 간의 동엽 (MDP)의 허용성 문제가 제기되거나 변호사전문자격사로 통합론이 제기되어 왔다. 4차 산업혁명시대에 지식재산과 특허 분쟁이 증가가 예견되고, 국내 산업기술보호와 지식재산권을 보호하기 위해서는 변리사 중심의 동업 즉 변리사와 변호사간의 법조전문자격사간 동업의 필요성이 요구되고 있다. 변리사법과 변호사법을 개정을 통하여 변리사의 법적지위를 강화함으로써 지식재산의 강국으로서 역할을 할 수 있도록 하여야 한다. 따라서 그동안 변리사가 법조전문자격사인데도 불구하고 비법조전문자격사로 분류되어 논의되어 온 점을 법조전문자격사로서의 변리사제도를 재조명하고, 변리사와 법조전문자격사 및 비법조전문자격사간의 동업의 의의와 장단점을 고찰한 후 변리사 중심의 변호사간의 동업의 필요성을 제기한다.

영문 초록

In the meantime, in Korea, due to the opening of the legal market, the competitiveness of the legal service has been strengthened and the law school has been introduced to the lawyer through the mass supply of the lawyer through the introduction of the law school. There has been a question of acceptability of non - attorney partnership (MDP) or the theory of integration has been raised by lawyers. In the fourth industrial revolution, intellectual property and patent disputes are expected to increase. In order to protect the domestic industrial technology and protect intellectual property rights, there is a need for partnership between patent attorneys and patent attorneys. The Patent Attorney Law and the Attorney Law should be amended to strengthen the legal status of patent attorneys so that they can act as a powerhouse of intellectual property. Therefore, we have reviewed the patent attorney system as a professional legal profession and discussed the merits and advantages and disadvantages of the partnership between patent attorneys and professional lawyers. Afterwards, the need for cooperation between attorneys centered on patent attorneys is raised.
