영문 초록

Digital environment such as ICT(Information Communication Technology), Internet and e-commerce changes our nations into the digital power. And with the progress of the digital environment, almost every transaction records among customers, businesses and governments can be generated, sent, received or stored by electronic documents. Reflecting these situation, The Ministry of Commerce, Industry & Energy(MOCIE) continuously improve the legal and policy revision for promotion of Electronic document usage and retention that Industry can save the expenses and maximize the electronic business activity. Major aspects on the electronic commerce framework revision(March, 2005) is as follows ; The electronic documenting may possible(from 28 Acts and 56 articles) that define the documents writing, and storing(Article 4 line 2). And providing the environment for electronic document usage acceleration that guarantee the electronic document in storage stage through the Authorized Electronic Data Message Retention Center System. It is the first time to introduce in the world, the Authorized Electronic Data Message Retention Center system that all the electronic document compulsorily stored by reliable and authorized third party. This paper generally deals with the provision of the Authorized Electronic Data Message Retention Center system such as appointment(§31-2), reasons for disqualification(§31-3), correction orders(§31-4), legal effect of Retention Center(§31-6), presumption of e-document(§31-7) etc. And finally this paper delivers you current issues concerning the Authorized Electronic Data Message Retention Center such as TTP s character, how to deal with the scanning document etc.
