진실화해위원회의 과거사 청산에 관한 고찰

국문 초록

한국을 비롯한 많은 나라는 독재, 식민지배, 인종차별 등의 폭력으로 아픈 과거사를 갖고 있는 사람들이 존재한다. 그래서 과거사 청산은 폭력 가해자와 피해자가 공존하는 위험을 방지하기 위한 방안이다. 그동안 과거사 청산의 필요성과 내용에 대하여 많은 논의가 있었지만 과거사 청산의 본질적인 의미는 진실화해위원회의 결성에 목적이 있는 것이 아니라 해당 기구가 입법 목적에 충실하게 소임을 다했는지 여부와 함께 활동 방향에 대한 논의를 해야 하는 것이다. 현재 ‘과거사 청산’의 사안들은 개별 입법화된 것부터 통합 입법화된 것까지 다양하다. 오랜 시간 동안 특정 역사 시점과 구조 속에서 발생한 과거사 청산과제를 하나로 파악하기 어렵기 때문에 입법운동도 개별적으로 진행되었다. 그러나 과거사 청산 문제는 사안별로 관련성을 맺고 있는 경우가 대부분이고 사안들이 해결되지 않았는지 여부는 정치 상황과 관련되어 있다. 특히 과거사 청산이 현대에서 이루어지는 의미를 파악하기 위해 과거사 청산 과제를 종합 적으로 고찰할 필요가 있다. 한국전쟁 전후 민간인학살 문제는 한국 사회의 과거청산을 위한 주요 과제 중 하나이다. 이 를 정부 차원에서 전국적 단위로 조사한 최초의 조직인 진실화해위원회가 5년 동안의 활동을 마치고 2010년 12월에 해산했다. 본 위원회는 한국사회의 국가폭력 관련 문제들을 모두 다룬 종합적 과거청산위원회였으며 희생자의 명예회복과 함께 이전의 국가기관이나 학계에서 밝혀내지 못했던 새로운 사실들을 발견하고 많은 역사적 자료를 수집하기도 했다. 그러나 위원회가 이 분야를 다룬 최초의 조직이었기 때문에 활동하면서 여러 가지 어려움이 있었고 시행착오를 겪었었다. 그래서 새로운 조사기구의 출범이 필요하다고 할 수 있다. 만약 새로운 조사기구가 출범한다면 신고기간과 조사기간에 대한 법적제약으로 미처 조사 하지 못한 미신청·미조사 사건을 처리 문제, 미군폭격 사건 등 조사가 미비했거나 진실규명기준의 일관성을 유지하지 못해 진실규명불능 또는 각하 결정한 일부 사건을 처리하는 문제, 신청사건 희생자의 개인별 희생사실을 규명하는 차원을 뛰어넘어 역사적·총체적 차원의 진실규명을 해내는 문제 등을 해결해야 할 것이다.

영문 초록

South Korea and several other countries have seen many people with a painful history in political terms. So to liquidate the past history is necessarily to prevent the risk of coexistence of violence victims and their persecutors. So far, there were a lot of discussions about the contents and needs for compensation for the past history. However, the essential meaning of the liquidation of the past history is not to establish the Truth and Reconciliation Commission (TRC), but to carry out such mission as specified in the Act for Truth and Reconciliation, and to fully discuss the desirable direction of the TRC activities. The facts of controversial cases have been legislated for the liquidation purpose in an individual or consolidated manner. In fact, it is difficult to understand the history of painful past as a whole which took place at a particular point of time line and political structure. Accordingly the efforts for the legislation for the liquidation purpose have been made case by case. However, the issue to liquidate the past history has substantial connections in each and all cases. Whether the case is closed depends on the political situation. Before and after the Korean War, tragic massacre of civilians took place and has posed a major challenge to the Korean society until now. The TRC had the authority to investigate such cases nationwide at a government level, and finally finished its activities in December 2010 after five-year operations. The TRC was a government body to deal with all the issues related to state violence against the people from the recovery of victims’ honor to the discovery and collection of historical facts that have never been disclosed. Owing to difficulties and trial and errors committed by the TRC, there is a need for a new institution with investigative powers. Such an investigative institution will be required to research into the unresolved or rejected cases including misguided bombings by US Air jet planes, and further to do overall historical fact finding.
