자치경찰제도 도입 논의에 관한 비판적 검토와 입법적 제언

국문 초록

지방자치가 시행되어 온 후 자치경찰에 관한 도입 논의는 지속적으로 전개되어왔다. 그러나 자치경찰제도는 제주특별자치도를 제외하고는 여전히 요원한 실정이다. 제주특별자치도의 경우에 있어서도 자치경찰이 실시되고 있으나 그 사무는 협의적 의미의 행정경찰에 한정되고 있어, 본연의 자치경찰제도의 취지를 구현하지 못하는 한계를 가지고 있다. 따라서 본 연구는 자치경찰제도가 도입될 경우 우선적으로 입법에서 전제되어야 할 사항에 대하여 그 내용을 검토하였다. 자치경찰제도는 지역 내의 치안업무는 지방자치단체가 스스로 자주적으로 처리하여 지역의 치안확보를 달성하여 지 역민에 치안서비스를 제공하는 것이 목표이다. 그럼으로 자치경찰제도를 도입하기 위하여 법률에서 별도의 법률을 제정하여 조직과 사무 그리고 재원에 대하여법에서 명확히 구현할 필요가 있다. 법치주의를 달성하기 위하여서는 법률에서 자 치경찰에 관한 내용을 명확하고 구체적으로 규정할 필요가 있다. 자치경찰에 관한 설치단위는 풀뿌리 민주주의를 기본으로 하는 지방자치의 기본이념에 따라 기초지방자치단체에 필수적으로 설치하도록 하는 것이 지방자치본질에 부합하게 된다. 자치경찰사무 또한 지역 내 치안과 관련한 모든 사무에 대 하여 전권한성을 가지고 자주적으로 처리하도록 하는 것이 자치경찰제도의 취지에 부합하게 된다. 따라서 본 연구는 자치경찰제도가 도입될 경우 자치경찰의 본연의 취지를 달성하기 위하여 자치경찰제도의 설치단위와 그 사무 그리고 재정원(財政源)을 법률에서 구체적으로 규정할 필요 등에 대하여 검토하였다.

영문 초록

The discussion about introducing self-governing police into Korea has been on the way since local autonomy was carried out. But self-governing police system is still not put into effect throughout the country, excluding Jeju Special Self-Governing Province. Although self-governing police is currently carried out in Jeju Special Self-Governing Province, its affairs are only limited to administrative police of a narrow meaning. So, it does not accord with the original purpose of self-governing police. Thus, this study reviewed what should be first set forth in the legislation in order to introduce self-governing police system. The purpose of self-governing police system is that each local autonomy keeps its public peace and order by itself so that it can provide safe security to the localities. To do so, it is necessary to establish additional laws which stipulate its organizations, affairs, and financial resources clearly and specifically. In addition, what is about self-governing police needs to be regulated obviously and specifically in the law so that legalism can be fulfilled. In accordance with the fundamental ideal of local autonomy, which is based on democracy of grass root, it is essential that each basic local self -governing community, such like Gu, Gun, and city, should carry out its own self-governing police by itself as well as its own affairs related with security. Therefore, with the assumption that self-governing police might be introduced in the future, this study reviewed the necessity of making the legislation that regulates a unit of building local-governing police system. For example, whether local-governing police system should be established in basic local self -governing communities of Gu, Gun, and small cities or in large ones, such like Daegu, Incheon, and Gwangju city. Also, this study specifically reviewed the affairs and financial resources of self-governing police.
