국문 초록

이 글은 퍼블리시티권과 표현의 자유 사이에 존재하는 내재적 긴장관계를 조화 및 균형 시킬수 있는 적절한 비교형량기준을 미국의 선례를 통하여 모색하는 것을 목적으로 한다. 이것은 한국에서 이제 막 실정법의 영역으로 진입하려는 퍼블리시티권의 범위를 기존의 법체계 맥락 하에서 조화롭게 획정하기 위한 노력의 일환과도 직결되는 사안이다. 그러므로 표현의 자유와 퍼블리시티권의 목적 및 보호 범위의 차이로 인해 두 법익의 충돌이 발생할 수밖에 없는 배경을 이해하고, 헌법상 2단계 내지 이중기준의 원칙에 따라 구별되는 비상업적 표현과 상업적 표현이 어떻게 퍼블리시티권 침해 여부 판단에 있어서 차이를 발생시키는지를 살펴보고자 한다. 더 나아가 ‘민주적 자치이론’에 기한 언론의 자유는 절대성을 갖고 있어 ‘뉴스적 가치의 예외’의 이론에 따라 상업적·비상업적 구분을 불문하고 퍼블리시티권 침해로부터 면책이 되는 예외를 고찰 한다. 이러한 기본적인 사항의 이해를 바탕으로 퍼블리시티권과 표현의 자유의 충돌 문제와 관련된 분쟁을 통일된 견지에서 심리 및 판단할 수 있는 적절한 판단 잣대, 즉 비교형량 기준을 탐색 하는 것을 논하고자 한다. 따라서 퍼블리시티권에 대하여 오랜 기간 심도 있는 논의를 한 미국의 현대적 비교형량 기준들을 연구하는 것이 필요할 것이다. 미국의 경우, 연방 대법원의 Zacchini 사건 판결에 뒤이어, 보다 체계화된 접근을 위하여 여러 비교형량 기준들이 나타나게 되었다. 여기에는 우세적 이용 기준, Restatement/Rogers 기준 그리고 변형적 이용 기준이 있는데 이들의 적합성을 각각 고찰하고, 저작권법상의 ‘공정이용 원칙’으로부터 도출된 변형적 이용 기준의 우월성을 논하고자 한다. 나아가 이러한 연구를 통하여 미국에서 주류를 이루고 있는 변형적 이용 기준이 우리나라의 법 실정과 체계에 맞추어 어떻게 수정되고 도입하는 것이 바람 직할 것인지에 대한 고찰이 필요하고, 적절한 비교형량 기준의 도출을 통하여 향후 퍼블리시티 권이 표현의 자유를 사전 검열하거나 억제하는 무분별한 권리가 되지 않도록 구체적 법리 구성이 이루어져야 할 것이다.

영문 초록

This paper intends to seek the proper balancing test, through the U.S. precedents, in order to reconcile an inherent tension between the freedom of expression and the right of publicity. This is a direct part of effort to stipulate the range of the right of publicity in harmony with our existing legal system. Therefore, it is required to understand the background that is an inevitable conflict caused by different purpose and scope of the two rights. It is an effort to resolve conflicts by bifurcating between commercial speech and expressive speech under the double standard of judicial review or different levels of scrutiny, which affecting a determination whether the right of publicity is infringed. Furthermore, this paper explores a newsworthy exception doctrine which is an immunity from liability of the right of publicity infringement with an absoluteness based on democratic self-governance theory. Equipped with this understanding, this article also aims to research that appropriate criteria (i.e. balancing tests) enable to examine and settle the disputes with a unified standpoint. For this reason, it is necessary to consider the harmony of the two rights thoroughly by exploring the U.S. balancing tests with an in-depth discussion. After Zacchini v. Scripps-Howard Broadcasting Co., it is appeared Predominant use test, Restatement/Rogers test and Transformative use test as an emerging modern balancing test for systemized approach in the United States. In this vein, this paper focuses on evaluating these balancing tests and suggesting the superiority of the transformative use test generated from ‘fair use’ of Copyright law. Through this research, it is needed to adopt and modify the U.S. transformative use test to Korea. Especially, the right of publicity must be enacted neither a censorship nor a suppression of freedom of expression and prevented from being reckless rights.
