국문 초록

UN 국제거래법위원회 (United Nations Commission on Intemational Trade Law, 이하 ‘UNCITRAL’)는 2016. 7. 1. ~담보거래에 관한 UNCITRAL 모멜볍(UNCITRAL Model Law on Secured Transactions)~ 을 공식적으로 채택하였다 UNCITRAL 제6작업그룹 (Worki맹 Group vI)은 2002년부터 동산 및 채권 담보제도에 관한 국제규범을 정립하기 위한 노력을 지속적으로 기울여 왔는데‘ 이번 모멜법은 그 긴 여정의 종합적 인 결실이다 모델법은 모두 107개 조항으로 구성되어 있다. 동산， 채권， 증권， 지식재산권 등 다ÒJ한 유형의 담보자산에 관한 담보권을 둘러싼 여러 가지 살체법적 문제뿐만 아니라 담보권의 실행과 관련된 집행법적 문제와 외국적 요소가 있는 담보거래에서의 국제사법 문제까지 규율하면서경과규정도 제시하고 있다. 모텔법은 법적 구속력을 가지는 규범이 아니지만. UN이 공식적으로 제시하는 일종의 표준 법제이므로 각국 업법에 사실상 영향을 미칠 수 있다 『담보거래에 관한 UNCITRAL 입볍지침 (UNCITRAL Legislative Guide on Secured Transactions)~은 2012. 6. 1 1.부터 시행된 『동산 • 채권 등의 담보에 관한 법률』의 제정 과정에서 요간한 참고자료로 활용된 바 있다. 이번 모델법도 향후 우리나라 동산채권담보법제의 개선 논의에 참 고할가치가 있다. 이 글에서는모멜법의 배경과주요내용을소개하고모델법이 우리 법제에주는 시사점을 언급하끄{ 한다. 아울러 필자가 2010년 이래 최근까지 UNCITRAL 담보거래 분야 제6작업그룹 회의에 참여하면서 국제규범 형성에 관하여 느낀 소회도 덧붙였다.

영문 초록

On July 1. 2016, The United Nations Commission on International Trade Law(‘UNCITRAL) officially adopted UNCITRAL Mαlel Law on Secured Transactions. UNCITRAL Working Group VI began its work toward establishing modern international instrument in the field of secured transaction since 2002. Along with several texts including UNCITRAL Legislative Guide on Secured Transactions that were adopted in 2007, the Model Law is the comprehensive and final instrument that embraces past products in pursuit of harmonizing law in the realm of secured transaction The Model Law is composed of 107 Articles on various types of movable asset including receivables, negotiable instruments, non-intermediated securities and intellectual property. The Model Law deals not only with substantive legal issues such as creation and effectuation of security right but also with procedural legal issues such as enforcement of security right, as well as issues regarding conflict of laws and transition. As the Legislative Guide was one of the significant scurce of reference in the making of current secured transaction regime in Korea, the Model Law presents another momentum to evaluate the current state of the secured transaction regime and to find room for its improvement. Against this backdrop, this article introduces the background and the main content of the Model Law, draws implication on Korean security right regime, and adds some more thoughts and comments on raising the possibility of Korea’s contribution to future discussion on international instruments.
